The Chequamegon area’s Apostle Islands National Lakeshore has been in the news lately due to the reintroduction of Congressman Tom Tiffany’s proposed Apostle Islands National Park and [Sand Island] Preserve Act.  This proposed Act has been controversial due to strong opposition from local governments citing lack of consultation and insufficient infrastructure, among other concerns.

The goal of this post is to raise awareness about how the current Apostle Islands National Lakeshore contains roughly 3,000 acres of tribal lands reserved by the 1854 Treaty of La Pointe, and should consider returning these tribal lands back to the Lake Superior Chippewa before making any changes to become the proposed Apostle Islands National Park and Sand Island Preserve.

The current Apostle Islands National Lakeshore contains 3 types of lands reserved by the 1854 Chippewa Treaty of La Pointe:
29 Allotments (red) within the Red Cliff Reservation,
14 Allotments (blue) on Stockton, Hermit, & Basswood Islands,
and the disputed Bad River Reservation (purple) on Long Island.

All of the Apostle Islands are part of the ceded territory from the 1842 Treaty of La Pointe covering roughly 22,000 square miles in northern Wisconsin and Michigan.  The historical context of this 1842 ceded territory was to allow Americans to move into copper-rich areas while still retaining hunting, fishing and gathering rights for the Lake Superior Chippewa on those same lands.  In modern context, this 1842 ceded territory has natural resource managed jointly between the States of Michigan and Wisconsin, the Lake Superior Chippewa, and Great Lakes Indian Fish & Wildlife Commission (GLIFWC).

The 1854 Treaty of La Pointe reclaimed certain lands within the 1842 ceded territory to be reserved as permanent homelands for the Lake Superior Chippewa Bands in the form of Reservations and Allotments.  For more information, we have covered the debates and circumstances leading up to the creation of these Reservations and Allotments in great detail on this blog, such as the Sandy Lake Tragedy and Ojibwe Removal events.  Unfortunately much of those Reservations and Allotments have become “checkerboarded” or alienated from the Lake Superior Chippewa despite the original intention of being permanent homelands.

In this post we will examine roughly 3,000 acres of those Reservations and Allotments from the 1854 Treaty of La Pointe that are contained within the Apostle Islands National Lakeshore today.  For clarification, there is a Reservation and several Allotments on Madeline Island, which are outside of the Apostle Islands National Lakeshore and will be discussed at a later date instead of in this post.  Nor are we including any of the 1887 Dawes Act Allotments on the Apostle Islands in this post, because they are not from the 1854 Treaty.

Zaagawaamikong-neyaashi

(roughly translated as “long soft beaver dam point”)

a.k.a. Chequamegon Point and Long Island

The Apostle Islands National Lakeshore contains Chequamegon Point (roughly 300 acres) on Long Island located at the Bad River Reservation (a.k.a. Mashkiiziibii).

Currently, federal maps of Long Island depict Chequamegon Point to lie outside the Bad River Reservation boundaries.  Ownership of Chequamegon Point has been disputed between Bad River and the Federal Government for many generations since the 1854 Treaty.

This dispute is based on how the Second Clause of the Second Article of the 1854 Treaty of La Pointe defined the boundaries of the Bad River Reservation to follow “along the lake shore, crossing Shag-waw-me-quon [Chequamegon] Point, to the place of beginning“.  In recent years, Bad River has been conducting a Historical Background Study about the 1854 Treaty of La Pointe and the Chippewa understanding of how they negotiated with Federal negotiators to include Chequamegon Point in Bad River’s lakeshore reservation boundaries.

We have mentioned this ongoing dispute in past posts, and will continue to examine historic records in support of Bad River’s efforts to repatriate tribal ownership of Chequamegon Point.

 


 

Gaa-giishkidaawangaa-wiikwedong

(roughly translated as “sand bay”)

a.k.a. Sand Point, Sand Bay, and Little Sand Bay

The Apostle Islands National Lakeshore’s Mainland Unit contains 29 Allotments (roughly 1,550 acres) located at the Red Cliff Reservation (a.k.a. Gaa-miskwaabikaang).  The Sand Bay shoreline contains three Allotments (uncolored) that are owned by Red Cliff.

The media often cites the 1887 Dawes Act when describing how Allotments on the Lake Superior Chippewa Reservations became alienated from tribal ownership.  That is factually incorrect, because these Allotments came from the 1854 Treaty of La Pointe, which precedes the 1887 Dawes Act by several decades.  The key difference here is how these 1854 Chippewa Treaty Allotments were designed to reserve tribal land that would never be taken away later, while the later 1887 Dawes Act Allotments were designed to be alienated/sold after a period of 25 years.  Unfortunately the 1854 Treaty Allotments were mismanaged by non-tribal governments as being temporary instead of permanent.

This mismanagement has caused much damage over time in the form of “checkerboarded” tribal land bases, which explains the legacy of how these 29 Allotments inside the Red Cliff Reservation fell out of tribal ownership and became part of the original boundaries of the Apostle Islands National Lakeshore.

In 1970, two additional Allotments along the Sand Bay shoreline were targeted to become part of the original boundaries of Apostle Islands National Lakeshore, but ultimately never became alienated from tribal ownership.  Today these two Allotments still remain excluded from the boundaries of the current Apostle Islands National Lakeshore and proposed National Park.

In 2018, a third Allotment along Sand Bay that had fallen out of tribal ownership due to “checkerboarding” was repatriated from Town of Russell ownership back to tribal ownership, and is now a Tribal Management Unit of the Apostle Islands National Lakeshore.

The proposed boundaries of the Apostle Islands National Park and [Sand Island] Preserve Act contain this repatriated Allotment, but not the two Allotments that were never alienated from tribal ownership.

 


 

Wiisaakodewan-minis

(roughly translated as “half-burnt wood island”)

a.k.a. Stockton Island or Presque Isle

The Apostle Islands National Lakeshore contains one allotment (roughly 80 acres) on Stockton Island:

The root word of island’s traditional name, Wiisaakodewan (half-burnt wood), refers to Stockton Island’s historic appearance of being partially burnt.  In recent years, the Apostle Islands National Lakeshore and the Lake Superior Chippewa have jointly reintroduced the practice of using prescribed fire management to promote the growth of blueberries and other traditional ecological resources on the cultural landscape of Stockton Island.

Wiisaakodewan also happens to be the root word of a pejorative slang term describing the Mixed Blood people of Lake Superior Chippewa.  At the time of the Treaty Era, the Mixed Bloods of the Lake Superior Chippewa held a strong connection to this island via the tribal fishing industry.  For example, the surveyor Joel Allen Barber described how “the bays on Presque Isle [Stockton Island] are a favorite resort of fishermen” in connection to the tribal fishing grounds of the La Pointe Indian Reservation on Madeline Island’s north end.

 


 

Wiigobiish-minis

(roughly translated as “basswood island”)

a.k.a. Basswood Island

The Apostle Islands National Lakeshore contains four allotments (roughly 290 acres) on Basswood Island:
1) John Baptist Berriot
2) Henry Bresette (a.k.a. Brisette)
3) John Baptist Lemieux
4) Louis Neveaux

In a previous post we briefly mentioned that the infamous John Breckenridge made national news with his land speculation on Basswood Island immediately following the 1854 Treaty of La Pointe.  In a few short years Breckinridge would become Vice President of the United States, and also a Confederate States Army brigadier general during the Civil War.

The United States’ 15th President James Buchanan, who presided over the dissolution of the Union with Breckinridge to become President of the Confederate States, was also involved with early land speculation on Lake Superior.  We will return to Buchanan and Breckinridge’s impact on Lake Superior politics and land speculation in a future post.

(roughly translated as “floating at the end or behind island”)

a.k.a. Hermit Island

f.k.a. Austrian Island

The Apostle Islands National Lakeshore contains nine allotments (roughly 780 acres) covering all of Hermit Island:

3) Francois Dejadin (a.k.a. Artishon) Junior
4) Charles Dingley
5) Mary Dingley
6) Mary DuBay
7) Louis Gaudin (a.k.a. Gordon)

9) Elizabeth (a.k.a. Isabella) Tremble

The traditional name of Eshkwegwindeg appears to be referencing this island’s location between the mainland and several other Apostle Islands.  Today it still remains a central hub between the Red Cliff Reservation, the La Pointe Reservation on the north end of Madeline Island, and the other Apostle Islands with Allotments.  It is noteworthy how the entirety of this Island is covered by Allotments, unlike the other aforementioned Islands.

Modern maps call this Hermit Island in reference to the colorful story of how William Wilson was ostracized from La Pointe and relocated to this Island to live out a solitary life during the Treaty Era.  The famous “brownstone king” Frederick Prentice‘s connection to this Island in later decades is also a popular story being told by tour guides in modern times.  However, I personally am more interested in exploring the history of how this Island was know as “Austrian Island” between the Wilson and Prentice eras, because it illustrates Julius Austrian’s abuse of Allotments to take private ownership of what should be tribal lands for personal profit.

I personally became very interested in Chequamegon history specifically because of Julius Austrian and his abuse of Allotments to take private ownership of what should be tribal lands in the Penokee Mountains for personal profit, and how that legacy evolved to become what is still known as the La Pointe Iron Company today.

Austrian’s land speculation on Hermit Island follows the same trend of using Allotments via power of attorney over Mixed Blood tribal members of the Lake Superior Chippewa to grab ownership of prime real estate before other land speculators.  In the Penokees example, Austrian gave each Mixed Blood $100 to sell their Allotments via Power of Attorney, but here we see how Austrian gave Mary DuBay only $5 for her Allotment on Hermit Island.

So what?

Regular readers of Chequamegon History know that my writing style is to post historic documents enhanced with multimedia and sidebars, but omit my own interpretations and and just let readers reach their own conclusions.  Leo, on the other hand, is more inclined to speak out about the implications, such as in his posts 19th Century Deer in the Headlights and Slavery, Debt Default, and the Sandy Lake Tragedy.  However, in this case, due to Congressman Tom Tiffany’s ongoing efforts despite strong opposition from local governments, I felt it was important to expound on this issue a bit more than I usually do.

Righting a Wrong: Restoring Lands to the Leech Lake Band of Ojibwe

In 2020, the Leech Lake Band of Ojibwe Reservation Restoration Act (Public Law 116-255) returned approximately 11,760 acres of allotted lands wrongfully taken by the Chippewa National Forest back to Tribal ownership and management.  The same concept should be applied to repatriate tribal lands in the Apostle Islands National Lakeshore before moving forward with the proposed Apostle Islands National Park and Preserve Act.

Tribes of the 1854 Chippewa Treaty in Michigan and Wisconsin have won two important lawsuits in recent years due to the fact that their tribal lands should have been reserved under the 1854 Treaty of La Pointe instead of becoming “checkerboarded” from illegal taxation/foreclosures.

Red Cliff Band of Lake Superior Chippewa Indians v. Bayfield County

What started off as a dispute about zoning authority over tribal lands has developed into a constructive partnership.  Bayfield County and Red Cliff have developed a Memorandum of Understanding that has led to repatriation of tribal lands within the Red Cliff Reservation.  This has led to 2,500 acres being returned by the County to Red Cliff in recent years, with the last 900 acres being completed in 2022.

While returning all County-owned surface rights within the Reservation back to the Tribe has been a tremendous achievement, the County still owns mineral rights within the Red Cliff Reservation.  Mineral rights supersede land rights under Wisconsin law, so more work still remains to be done in these land repatriation efforts between Bayfield County and Red Cliff.

Bayfield County should promote their efforts in recent years to help Red Cliff repatriate 2,500 acres of County-owned lands back to tribal ownership, and encourage the Apostle Islands National Lakeshore to return their 3,000 acres of Reservation/Allotments back to tribal ownership.

Frog Bay Tribal National Park

Congressman Tom Tiffany claims that his proposed Apostle Islands National Park and Preserve Act would create the first National Park in Wisconsin.  However, Red Cliff already earned that claim to fame in 2012 by establishing the Frog Bay Tribal National Park through an innovative partnership to repatriate Allotments on their Reservation from non-native landowners.

We would much rather see the establishment of a Sand Bay Tribal National Park in Red Cliff, a Chequamegon Point Tribal National Park in Bad River, and Tribal National Parks for the Apostle Islands Allotments, before the proposed Apostle Islands National Park and Preserve.   Ultimately these Tribal Lands should be returned to the Lake Superior Chippewa and let them decide whether to manage them as Tribal National Parks or not.

ARTICLE 2. The United States agree to set apart and withhold from sale, for the use of the Chippewas of Lake Superior, the following-described tracts of land, viz:

6th [Clause]. The Ontonagon band and that subdivision of the La Pointe band of which Buffalo is chief, may each select, on or near the lake shore, four sections of land, under the direction of the President, the boundaries of which shall be defined hereafter. And being desirous to provide for some of his connections who have rendered his people important services, it is agreed that the chief Buffalo may select one section of land, at such place in the ceded territory as he may see fit, which shall be reserved for that purpose, and conveyed by the United States to such person or persons as he may direct.

The Ontonagon Band and Chief Buffalo’s Subdivision of the La Pointe Band got lumped together in this clause, so let’s review the Ontonagon Band first.  Less than one year after the 1854 Treaty, the Ontonagon Band selected four square miles for their Reservation as approved by President Franklin Pierce’s Executive Order of September 25, 1855.  Today the Ontonagon Band Reservation still has its original shape and size from 1855 despite heavy “checkerboarding” of its landownership over time.

In comparison to the Ontonagon Band Reservation, the history of how Chief Buffalo’s Reservation got selected is not so straightforward.  Despite resisting and surviving the Sandy Lake Tragedy and Ojibwe Removal, making an epic trip to meet the President at Washington D.C., and securing Reservations as permanent homelands for the Chippewa Bands in the 1854 Treaty, Chief Buffalo of La Pointe died in 1855 before being able to select four square miles for his Subdivsion of the La Pointe Bands.

Fortunately, President Franklin Pierce’s Executive Order of February 21, 1856 withheld twenty-two square miles of land near the Apostle Islands from federal public land sales, allowing Chief Buffalo’s Estate to select four of those twenty-two square miles for their Reservation without competition from squatters and other land speculators, while other prime real estate in the ceded territory of La Pointe County was being surveyed and sold to private landowners by the United States General Land Office.

This 1856 Reservation of twenty-two square miles for Chief Buffalo’s Estate set the stage for what would eventually become the Red Cliff Reservation.  We will return to this 1856 Reservation for Chief Buffalo’s Estate in several upcoming posts exploring more records about Red Cliff and the other La Pointe Band Reservations.

In obedience to the above order I herewith enclose a map marked A. Showing by the blue shades thereon, the Townships and parts of Townships desired to be reserved, no portion of which are yet in market, to wit:

Previously we featured 1837 Petitions from La Pointe to the President about $100,000 Payments to Chippewa Mixed-Bloods from the 1837 Treaty of Saint Peters, and 1838 more Petitions from La Pointe to the President about relocating the Payments from St. Croix River to Lake Superior.  Those earlier Petitions were from Chief Buffalo and dozens of Mixed-Bloods from the Lake Superior Chippewa Bands, setting precedence for La Pointe to host the 1842 Treaty and 1854 Treaty in later decades.

Today’s post features 1839 Petitions against Payments at La Pointe.  These petitioners appear to be looking to get a competitive edge against the American Fur Company monopoly at La Pointe, by moving the payments south across the Great Divide into the Mississippi River Basin.

Jean Joseph Rolette (Sr.) originally moved to Prairie du Chien in the early 1800s as a Canadian fur trader where he married into the Mdewakanton Dakota Tribe.  Despite his British military service against the United States in the War of 1812 he remained at Prairie du Chien, partnered with the American Fur Company in 1820, and became a Crawford County Judge in 1821.  In the late 1830s he was bankrupted by the end of the fur trade and was seeking any competitive edge against the American Fur Company.

You must excuse the liberty I take in addressing you once more – presuming you are not well acquainted yet with this Country, I am requested by the Chippewaw half Breeds that remain in this Country, that it is with regret they have heard that the payment allowed to them in the treaty of the 29th July 1837 is to be made on Lake Superior.  They have to State, that it will be impossible for them to reach that place as the American Fur Co. are the only Co. who have vessels on Lake Superior & Notwithstanding they could procure on Passage Gratis on the Lake.

This distance between Sault Ste Mary, and the Mississippi is great and expensive.  They also represent that the half Breeds born on Lake Superior are not entitled to any Share of the money allowed.

Before roads and rails to Lake Superior were built decades later, St. Croix Falls was the northernmost limit of large boats transporting goods from traders at Prairie du Chien and other ports along the Mississippi River.

Whereas if the Payment was made at the Falls of St. Croix, there would be Competition amongst traders, whereas in Lake Superior they can be done none.  They humbly beseech that you will have Mercy on them and not allow them to be deprived by intrigue of the Sum due them.  So Justly to go in other hands but the real owners.

Lawrence Taliaferro was both an Indian Agent and slaveowner, and played an indirect role in the U.S. Supreme Court’s Dred Scott case.
The document from the Chiefs of the St. Croix River Band dated June 4th, 1839 hasn’t been found yet.

I deem it to be most adviseable that the enclosed paper, addressed to the Agent, and Commanding Officer on this Station from the Chippewa Chief “Hole in the Day” should be forwarded to you, the Indians addressing us being within your Excellency’s Superintendency.  It may be well to add that a similar document proceeding from the Chippewa Chiefs of St Croix was on the 4th inst forwarded for the information of the Office of Indian Affairs at Washington.

The consolidation of the two Chippewa Sub Agencies and located at Lapointe, it is feared may lead to rather unpleasant results.  I know the Chippewas well, and may have as much influence with those of the Mississippi particularly as most men, yet were I to say “you are not to have an agent in your Country, and you must go to Lapointe in all time to come for your Annuity, and treaty Stipulations.”  I should not expect to hold their confidence for one day.

I have been earnestly selected by a number of the respectable half breed Chippewas resident, and others of the Mississippi, interested in the $100,000 set apart in the treaty of July 29, 1837 of S. Peters, to ask for such information as to their final disposal of this Sum, as may be in your possession.

The claimants referred to have learned through the medium of an unofficial letter from the Hon Lucius Lyon to H. H. Sibley Esqr. of this Post, that the funds in question as well as the Debts of the Chippewas to the traders was to be distributed by him as the Commissioner of the United States at Lapointe on Lake Superior, and for this purpose should reach that place on or about the 10th of July.  The individuals Seeking this information are those who were were so greatly instrumental in bungling your labours at the treaty aforesaid to a successful issue in opposition to the combinations formed to defeat the objects of the government.

There remains 56,000$ in specie at this post being the one half of the sum appropriated or applicable to the objects in contemplation, and upon which the authorities here have had as yet no official instructions to transfer some special information would relieve the minds of a miserably poor class of people and who fear the entire loss of their just claims.

Peter Patrick Quinn was a Selkirk Settler from the Red River Colony who came to Fort Snelling in 1824, where he became an Indian Agency farmer and interpreter in the Dakota and Chippewa languages.

On the 20th of May past I dispatched Peter Quin Express to the Chippewas of the Upper Mississippi with a letter from Maj D. P. Bushnell agent for this tribe at Lapointe notifying the Indians, and half breeds that they would be paid at Lapointe hereafter, and at an earlier period than the last year.  I informed you of the result of his mission on the 10th inst. enclosing at the same time the written sentiments of the principle Chief for his people.  I now forward by Express a second communication from the Same Source received late last night.  I would make a plain copy, but have not time. So the original is Sent.

In four days there will be a large body of Chippwas here, and they cannot be Stopped.  There are now also 880 Sioux from remote Sections of the Country at this Post and of course we may calculate on some difficulty between these old enemies.  Your presence is deemed essential, or such instructions as may soothe the Angry feelings of the Chippewas, on account of the direction given to their annuity, & treaty Stipulations.

(NB)  The Chippewas are to be understood as to the point of payment indicated to be the St.Croix, and not the S.Peters, as deemed by the written Talks.  It never could be admited in the present state of the Tribes to pay the Chippewas at this Post, but they might with safety to all parties be paid at or above the Falls of S.Croix, by an agent who they ought to have or some special person assigned to this duty.

“Toliver” is how the surname Taliaferro was pronounced in this part of the world at that time.
“Plimpton” was Joseph Plympton, the Commander at Fort Snelling, who was accused of using his position in the military to illegally grab lands from settlers.
“Pah-ko-ne-ge-zeck or Hole in the Day” was Bagon-giizhig the Elder from the Mississippi River Band of Ojibwe.  He was an uncle of Antoine Gordon.  Photographs of “Hole In The Day” are his son Bagon-giizhig the Younger (Antoine Gordon’s cousin) in later decades.

My respects to you both, and my hand: I am to let you know that I intend to pay you a visit, with my chiefs as braves, the principle of my warriors are verry anxious to pay you a visit.

The above mentioned men are verry anxious to see Gov. Dodge with whom we made the treaty, that we may have a talk with him.  It was with him commissioner of the United-States we made the treaty, and we are verry much disappointed to hear the newes, we hear this day (IE that we must go to Lake Sup. for our pay) which we have this day decided we will not do; that we had rather die first: it is on this account we wish to pay you a visit, and have a talk with Gov. Dodge.  You sir, Maj Toliver know verry well our situation, and that the distance is so great for us to go to Lake Sup. for to get our pay &c. or even a gun repaired; that it is inconsistent for such a thing to be required of us; even if we did literally place the matter in the hands of Government.  We are all living yet that was present at the treaty when we ceded the land to the Unitedstates, and remember well what was our understanding in the agreement.

We now wish Maj Toliver; to mention to your children that it is a fals report that we had any intention to have more difficulty with the Sioux, as our Missionaries can attest as far as they understand us.  We will be at the Fort in seventeen days to pay you a friendly visit as soon as we received the news; we sent expressed to our brethren to meet us at the mouth of Rum Riv. and accompany us to the Fort.

It is my desire that Maj Plimpton would keep fast hold of the money appropriated for my children the half breeds, in this section, and not let it go to Lake Sup. as they are like ourselves and it would cost them a great deal to go there for it.

My hand, It is twelve dayes since we have the newes and are all qouiet yet.  My father I shall not forget what was promiced us below, I think of what you promiced us when you were buing our lands.

My father this is the thing that you & we me to take care of when you bougt our lands & I remember all that you said to me.  My father I am the cheif of all the Indians that sold there land and this is the time when all of your children are coming down to receive their payment where you promiced to pay us.

My father I am the cheif and hold the paper containing the promices that you made us.  The Gov. D. promised us that in one year from the date of the treaty that we should receive our first payment and so continue anually.

My father; I have done for manny years what the white men have told me and have done well, and now I must look before we are to know what I have to do.

When I buy anything I pay immediately the Great Spirit knows this Now when we get below we are expecting all that you promiced us Ministers and Black Smiths and cattle.

I say my father that we want our payment at St Peters where you promiced us.  I said that I wanted the half breeds to be payed there with us.  I told you that when the half breeds were payed that there was some French that should have something ((ie) of the half breed money) because they had lived with us for many years and allways gave us some thing to eat when we went to their houses.

My father all of your children are displeased because you are to pay us in another place and not at St Peters it is to hard and far for us to be payed at Lapointe.

My father I did not know that the payment was to be made at Lapointe until we heard by Mr Quin.

My father it is so far to Lapointe that we should lose all of our children before we could get their and if we should brake our Gun we may throw it in the water for we cannot go there to get it mended, and if we have a [illegible] holding a coppy of the Treaty in his hand

Black Smith we want him here and not at Lapoint.

My father I want that you should tell me who it was told you that we all wanted our payment at Lapoint.  All of the Cheifs are alive that hear what you said to us below.  You Mr Toliphero hear me ask Gov Do’ for an Agen and to have him located here and he promiced that it should be so.  I want that the Agent should be here because our enemies come here sometimes and if he was here perhaps they would not come.  My father we are all of us very sorry that we did not ask you to come and be our Agent.  I don’t know who made all of the nois about our being payed at Lapoint.  I don’t look above where we should all starve for our payment but below where the Treaty was made.

My father give my compliments to all of the officers at the Fort.

Du Roy: “Do you known the summer voyage our most reverend friend, your companion, once made in a birch-bark canoe right across Lake Superior?  Ah! that is a celebrated voyage, which everybody round the lake is acquainted with.  Indeed, there is hardly a locality on the lake which is not connected with the history of his life, either because he built a chapel there, or wrote a pious book, or founded an Indian parish, or else underwent danger and adventures there, in which he felt that Heaven was protecting him.

“The aforesaid summer voyage, which I will tell you here as companion to his winter journey, was as follows:

“He was staying at that time on one of the Islands of the Apostles, and heard that his immediate presence was required at one of the little Indian missions or stations on the northern shore of the lake.  As he is always ready to start at a moment, he walked with his breviary in his hand, dressed in his black robe, and with his gold cross fastened on his breast – he always travels in this solemn garb, on foot or on horseback, on show-shoes or in a canoe – he walked, I say, with his breviary in his hand and his three-corned hat on his head, into the hut of my cousin a well-known Voyageur, and said to him: Dubois, I must cross the lake, direct from here to the northern shore.  Hast thou a boat ready?’

‘My boat is here,’ said my cousin, ‘but how can I venture to go with you straight across the lake?  It is seventy miles, and the weather does not look very promising.  No one ever yet attempted this “traverse” in small boats.  Our passage to the north shore is made along the coast, and we usually employ eight days in it.’

‘Dubois, that is too long; it cannot be.  I repeat it to thee.  I am called.  I must go straight across the lake.  Take thy paddle and “couverte,” and come!’  And our reverend friend took his seat in the canoe, and waited patiently till my obedient cousin (who, I grant, opened his eyes very wide, and shook his head at times) packed up his traps, sprang after him and pushed the canoe on the lake.

“Now you are aware, monsieur, that we Indians and Voyageurs rarely make greater traverses across the lake than fifteen miles from cape to cape, so that we may be easily able to pull our boats ashore in the annoying caprices of our weather and water.  A passage of twenty-five or thirty miles we call a ‘grand traverse,’ and one of seventy miles is a impossibility.  Such a traverse was never made before, and only performed this once.  My cousin, however, worked away obediently and cheerfully, and they were soon floating in their nutshell in the middle of the lake like a loon, without compass and out of sight of land.  Very soon, too, they had bad weather.

“It began to grow stormy, and the water rose in high waves.  My cousin remarked that he had prophesied this, but his pious, earnest passenger read on in his breviary quietly, and only now and then addressed a kind word of encouragement to my cousin, saying that he had not doubted his prophecy about the weather, but he replied to it that he was called across the lake, and God would guide them both to land.

“They toiled all night through the storm and waves, and, as the wind was fortunately with them, they moved along very rapidly, although their little bark danced like a feather on the waters.  The next morning they sighted the opposite shore.  But how?  With a threatening front.  Long rows of dark rocks on either side, and at their base a white stripe, the dashing surf of the terribly excited waves.  There was no opening in there, no haven, no salvation.

‘We are lost, your reverence,’ my cousin said, ‘for it is impossible for me to keep the canoe balanced in those double and triple breakers; and a return is equally impossible, owing to the wind blowing so stiffly against us.’

‘Paddle on, dear Dubois – straight on.  We must get through, and a way will offer itself.’

“My cousin shrugged his shoulder, made his last prayers, and paddled straight on, he hardly knew how.  Already they heard the surf dashing near them; they could no longer understand what they said to each other, owing to the deafening noise, and my cousin slipped his couverte from his shoulders, so as to be ready for a swim, when, all at once, a dark spot opened out in the white edge of the surf, which soon widened.  At the same time the violent heaving of the canoe relaxed, it glided on more tranquilly, and entered in perfect safety the broad mouth of a stream, which they had not seen in the distance, owing to the rocks that concealed it.

‘Did I not say, Dubois, that I was called across, that I must go, and that thou wouldst be saved with me?  Let us pray!’ So the man of God spoke to the Voyageur after they had stepped ashore, and drawn their canoe comfortably on the beach.  They then went into the forest, cut down a couple of trees, and erected a cross on the spot where they landed, as a sign of their gratitude.

“Then they went on their way to perform their other duties.  Later, however, a rich merchant, a fur trader, came along the same road, and hearing of this traverse, which had become celebrated, he set his men to work, and erected at his own expense, on the same spot, but on a higher rock, a larger and more substantial cross, which now can be seen a long distance on the lake, and which the people call ‘the Cross of —–‘s Traverse.’

 


 

LIFE AND LABORS OF BISHOP BARAGA

A short sketch of the life and labors of Bishop Baraga

The Great Indian Apostle of the Northwest.

Father John Chebul arrived on Lake Superior at the Sault in October 1859 to assist his fellow Slovanian Bishop Baraga.  Chebul spent the winter at Ontonagon with miners before arriving at La Pointe in May 1860.

On another occasion Father Baraga went to Ontonagon from La Pointe.  We will relate the incident as told to the writer by Rev. John Cebul, of Newberry, Mich.  He was well acquainted with Bishop Baraga, being a fellow countryman who had been sent to La Pointe in 1860, where he labored amongst the Chippewas of that island and Bayfield, Bad River Reserve, Superior and other places, for about thirteen years, being universally loved and esteemed by all.  He says:

Baraga’s faithful man from the island is identified as two different men in these stories.
Cadotte point, about 20 or 30 miles from Ontonagon appears to be near the Porcupine Mountains.

Bishop Baraga was intending to go on the ice to Ontonagon.  He was accompanied by a man from the island.  The reason they took to the ice was because it was much nearer and the walking a great deal better than on the main land.  During March and April the ice on Lake Superior becomes honey-combed and rotten.  If a strong wind blows, it cracks and moves from the shore if the wind blows from the land. Such fields of ice does not notice that he is in danger till he comes to the edge of the ice and then to his horror discovers a large expanse of open water between him and the mainland.  Should the ice float out towards the middle of the lake or break up, he is lost.  Father Baraga and his companion had traveled on the ice for some time, thinking all was right.  All at once they came to the edge of the ice and saw it was impossible to reach land, as the wind had driven the ice from the shore out into the Lake.  His companion became greatly alarmed.  Father Baraga remained calm, praying, no doubt, fervently to Him who alone could save them.  Finally the wind changed and drove the cake of ice on which they were floating to the shore.  They landed at Cadotte point, about 20 or 30 miles from Ontonagon, having been carried by the wind on their ice raft about sixty miles.  “See,” said the good priest to his companion, “we have traveled a great distance and yet have not labored.”  It seems the good God wanted to save the saintly missionary a long and painful walk, by giving him a ride of sixty miles on a cake of ice.

CHAPTER XXXVI. Wonderful Escape of Father Baraga, When Crossing Lake Superior In A Small Sail Boat.  His Adventure On A Floating Field Of Ice.

We learn from F. Baraga’s letter, written in October, 1845, that he intended to go to Grand Portage, Minn., the next fall to build a church there.  It is, therefore, highly probable that he made that trip in the fall of 1846.  He first went to La Pointe, where, no doubt, he spent some time attending to the spiritual wants of the good people.  He then engaged a half-breed Indian, named Louis Gaudin, to go with him to Grand Portage.  They had but a small fishing boat with a mast and sail, without keel or centre-board.  Such a boat might do on a river or small lake, but would be very unsafe on a large lake, where it would easily founder or be driven lake a cork before the wind.  The boat was but eighteen feet long.  When they started from La Pointe, the people laughed at them for attempting to make the journey.  They said it would take them a month to make the voyage, as they would have to keep close to the shore all the way, going first west some seventy miles to the end of the lake and then, doubling, turn northward, coasting along the northern shore of Lake Superior.  this would make the distance about two hundred miles, perhaps even more.

However, Father Baraga and his guide set out on their perilous journey.  At Sand Island they awaited a favorable wind to cross the lake, which is about forty miles wide at that place.  By so doing they would save from eight to one hundred miles, but would expose themselves to great danger, as a high wind might arise, whilst they were out on the open lake, and engulf their frail bark.

They set sail on an unusually calm day. Father Baraga steered and Louis rowed the boat.  Before they got midway a heavy west wind arose and the lake grew very rough.  They were constantly driven leeward and when they finally reached the north shore they were at least thirty miles east of their intended landing place, having made a very perilous sail of seventy miles during that day.

While in the height of the storm, in mid-ocean, it might be said, Louis became frightened and exclaimed in Chippewa to the Father, who was lying on his back in the boat, reciting his office in an unconcerned manner: “Nosse, ki ga-nibomin, gananbatch” – Father, perhaps we are going to perish!”  The Father answered quietly: “Kego segisiken, Wizon” (Chippewa for Louis) – “Don’t be afraid, Wizon; the priest will not die in the water.  If he died here in the water the people on the other shore, whither we are going, would be unfortunate.”

When nearing the north shore the danger was even greater than out on the open water, for there were huge breakers ahead.  Louis asked the Father whither to steer, and, as if following a certain inspiration, F. Baraga told him to steer straight ahead for the land.  Through a special disposition of Divine Providence watching over the precious life of the saintly missionary, they passed through the breakers unharmed and ran their boat into the mouth of a small river, heretofore unnamed, but now called Cross River.

Full of gratitude for their miraculous escape, they at once proceeded to erect a cross.  Hewing a tree in a rough manner, they cut off the top as far up as they could reach, and taking a shorter piece, they nailed it cross-wise to the tree.  “Wizon,” said the Father, “let us make a cross here that the Christian Indians may know that the priest coming from La Pointe landed here.”  The cross was, it is true, unartistic, but it was emblem of their holy faith and it gave the name, Tchibaiatigo-Sibi, “Cross River,” to the little stream where they landed.

They arrived none too soon.  Ascending an eminence and looking out on the immense lake they saw that the storm was increasing every moment; high waves with white caps, which would surely have engulfed their little bark.  They landed about six o’clock in the evening.  Having spent the night there, they continued their journey next day, and in two days arrived at Grand Portage, having made the whole journey in three days.  May we not think with Louis Gaudin that their safe passage across the stormy lake, and their deliverance from a watery grave, was due to a special intervention of Divine Providence in favor of the saintly missionary?

In 1667 Father Claude Allouez, S. J., then stationed at the mission of the Holy Ghost at the head of Chequamegon Bay, made the voyage across the lake from Sand Island.  He made the voyage in a birch-canoe with three Indians.  He remarks that they paddled their canoe all day as hard as they could without intermission, for fear of losing any of the beautiful calm weather they had.  It took them twelve hours to make the trip across.  The Father was then on his way to visit some Christian Indians residing at Lake Nipigon – “Animibigong” in Chippewa.  For the particulars of this journey we refer the reader to “Missionary Labors of Fathers Marquette, Allouez, and Menard in the Lake Superior Region.”

The following narrative is not to be found in any of Baraga’s published letters, but the writers has it from the mouth of trustworthy persons, among whom is Father Chebul, a countryman of F. Baraga, who was stationed at Bayfield for many years.  We will give the account, as we have it from Rev. F. Chebul.

Francois Newago, Sr. is the man named Newagonfrom Madeline Island, as his children were still young teenagers then.

One time F. Baraga was going to Ontonagon in company with an Indian half-breed in the month of March or April.  At that season of the year the ice, though thick, becomes honey-combed and rotten.  Some say that Baraga’s companion was a man named Newagon.  They went on the ice at La Pointe Island.  As the walking on the sandy beach would have been very fatiguing and long, they determined to make straight for Ontonagon over the ice.  By so doing they would not only have better walking, but also shorten their way a great deal.

A strong southwest wind was blowing at the time, and the ice, becoming detached from the shore, began drifting lakeward.  After they had traveled for some time, they became aware of what hat happened, for they could see the blue waters between them and the shore.  Newagon became greatly alarmed, for almost certain death stared them in the face.  Had the wind continued blowing in the same direction, the ice would have been driven far out into the lake and broken up into small fragments.  They would surely have perished.

To encourage the drooping spirit of his companion, F. Baraga kept telling him that they would escape all right and that they must trust in God, their loving Father and Protector.  He also sang Chippewa hymns to divert Newagon’s attention and calm his excitement.  Finally the wind shifted and blew the field of ice back towards the shore.

appears to be located at what is now Silver City at the mouth of Iron River and eastern trailhead to the Porcupine Mountains.
Michel Cadotte, Sr. ran a trading post by the Old French Fort on Madeline Island around 1800 and smaller stations scattered along the Wisconsin / Michigan shoreline of Lake Superior.  Cadotte first worked for the British North West Company and later the American Fur Company after The War of 1812.

They landed near Cadotte Point, near Union Bay, a short distance from Ontonagon, which they reached that same day.  “See,” said the missionary to his companion, “we have traveled a great distance and have worked little.”  The distance from La Pointe to Ontonagon is about sixty or seventy miles by an air line.  Had they been obliged to walk the whole distance around the bend of the lake, it would probably have taken them two or three days of very hard and fatiguing traveling.  So what at first seemed to threaten certain death was used by God’s fatherly providence to shorten and facilitate the saintly priest’s journey.

BISHOP BARAGA’S TRIP TO ONTONAGON

and Elizabeth (Gordon) Belanger.  The Belanger Settlement was founded by their son Frank Belanger, Jr. and Elizabeth (Morrow) Belanger.

The journey I am about to describe is taken from the many experiences of Bishop Baraga, which were related to me by my grandfather.  It deals with a journey made at an almost impossible time for ice travel on any of the Great Lakes, and portrays the important part the elements can play in a man’s life, for good or bad, for weal or for woe, as well as Bishop Baraga’s unfaltering confidence in Divine Providence.

Baraga’s guide Louis Gordon was Obern’s great-uncle.

The season of the year in which this incident took place was in the spring – along in April.  Bishop Baraga and his faithful guide, Louis Gordon, started from LaPointe enroute to Ontonagon, Michigan, a distance of some eighty or ninety miles from LaPointe, straight across as the crow flies over the frozen water of Lake Superior.  Dogs were used to a very large extent in those days for the purpose of transportation.

On account of the prevailing soft weather, the ice on the lake was not very solid, and with the right kind of wind, a general break-up was apt to occur at any time.  In this instance, when the Bishop and his guide were about ten miles from LaPointe a south-west wind began to blow, increasing in velocity with each passing hour.  The ice broke away from the shore, and began drifting outward into the open waters of Lake Superior, carrying its passengers with it.  The guide, seeing the danger, suggested to the Bishop that they land on one of the islands, but the Bishop told him not to worry and to keep going in the direction of Ontonagon; that with the help of God they would reach their destination in safety.

With the coming of night the wind increased, and the two travelers were drifting out into the open waters with considerable speed.  Soon the mainland was lost to view, and the guide knew that to remain on the ice mean ultimate death by freezing or drowning, but it was too late to do anything now.  They had passed up the opportunity of getting off.

The missionary told Louis to look out for the dogs, and after taking a lunch, he wrapped himself up and went to sleep.  He advised the guide to do likewise.  The guide wrapped himself up, but he did not sleep.  He kept constant vigil; about midnight the wind changed, coming from the opposite direction.

The guide woke Bishop Baraga, telling him that the wind had changed.  The priest asked his guide from what direction it was blowing, and upon being told that it was coming from the north-east remarked, “It is just what I hoped for and suspected.”  He again told his guide to lie down and go to sleep, but the guide fearing that the plate of ice they were on might break up, would not sleep.  They began to drift back almost in the same direction they had come, and when daylight came the outline of the Porcupine Mountains could be plainly seen in the distance.  They were traveling at a very high rate of speed, and about mid afternoon they landed on the south shore of Lake Superior, one mile from Ontonagon, their destination.

“There,” said the bishop after they got off the ice and stepped on to the mainland, “this is just what I expected.”

At the time of this narrative, Ontonagon was a small settlement of Indians with but a few white men, who were engaged in the fur trade with the Indians and represented the American Fur Company.

Cross River

ORIGIN OF THE NAME

The story I am about to relate deals with an incident of one of the many experiences of Bishop Baraga.  The narrative was related to me by my grandmother, Elizabeth Bellanger, who before her marriage was Elizabeth Gordon.  She was a blood relative of Father Philip Gordon. The Gordon family consisted of the parents; sons, John, Louis and Antoine, and daughters My grandmother (Elizabeth) and Angelique.

Louis Gordon acted as the guide and all-around servant of Bishop Baraga, the missionary priest.  The latter had a very large territory to cover; the northern and southern shores of Lake Superior, thence to the Dakotas and down to the waters known as Chippewa River, which emptied into the Mississippi below St. Paul.

Louis Gordon, the guide, (my grand-uncle) told of many of the experiences he had on these trips with Bishop Baraga.  In speaking of my grand-uncle, Louis Gordon, I wish to state first, upon my honor as a gentleman, that he was a Christian in every sense of the word; he never took a drink of intoxicating liquor in his life; and never used profane language.

The stories related to me by my grandmother I well remember, and coming from a man like my grand-uncle, I believe them.

One day Bishop Baraga and his guide, Louis Gordon, started from LaPointe, on the western end of Lake Superior, near the place now known as Bayfield, on the shore of the lake, and about twenty-five miles from the present city of Ashland.  At the time of this incident there were no white settlements to speak of at the western end of Lake Superior and the “head of the lakes” region.  Bayfield, Washburn, Ashland, Superior and Duluth did not exist in those days.  There were few white men among the Indians, and those few represented the American Fur Company.  A few, mostly Frenchmen, had in former years settled in Minnesota and Wisconsin.

As formerly stated the trip started from LaPointe.  It was to be made by water, and the boat used by the missionary and his guide, from the description given, could not have been more than 16 or 18 feet long.  It was just large enough to accommodate the Bishop and his guide and to take care of their camping equipment, and although small, it came out the victor in many storms, proving itself quite seaworthy.  These voyagers had a make-shift sail, which furnished them power when the wind was fair, probably a blanket which was raised on a pole; but in calm weather, or when the seas became too rough, the craft was usually propelled with oars.  Wind and weather conditions in those days controlled lake travel largely, and when the lake became too rough and the seas too choppy, the voyageurs usually made a landing in some bay or stream outlet.

In this instance, the missionary and his guide were headed for Grand Marias, on the north shore of Lake Superior, a distance of fifty or fifty-five miles from the group of islands known as “Apostle Islands.”  Leaving LaPointe, it was necessary for them to cross Lake Superior, traveling directly North.  In the event of a severe storm, there is, of course, no place for shelter in the open waters of Lake Superior, and when once started it was necessary for them to continue their voyage until they reached Grand Marias, the point of their destination.

When the Bishop and his guide were about to leave the Apostle Islands, Louis Gordon, the guide, said to Bishop Baraga: “No-say,” (meaning father in Chippewa), “it would not be safe for us to cross the lake in this small boat today.  The wind is from the south-west, and it is getting stronger.  The lake will become very rough, the seas high, and I am afraid we may perish if we venture out in this wind.  We had better not leave this island today, or else follow the south shore around to the end of the lake, so we can find a place to land should the seas become too rough.”

Bishop Baraga replied, “My son, have faith in God.  Across that lake my Indians are waiting they must be expecting me, and it is my duty to get there as soon as possible.  It would be a waste of time for us to go along the south shore, then along the north shore from the St. Louis River to Grand Marias, when we can cross here and save many miles of hard rowing and precious time.  We will trust in God and make the crossing in safety.”

So, Louis Gordon, having unbounded faith in the Bishop, obeyed him, and they began their voyage across the lake, notwithstanding the fact that the wind was increasing in fury and the seas becoming higher and rougher with each passing moment.  After they got into the open waters, the guide had considerable difficulty in manning the boat and keeping it from being swamped by the breaking seas.  He stood up, and turning to Bishop Baraga said, “No-say, we will never reach the shore.”  The Bishop was sitting at the stern of the boat, reciting his breviary.  “Louis,” he said, “do not lose faith in God; fear not, He is with us.”   The guide was kept busy in keeping the boat in its course, and bailing it out, to prevent it from being filled as the white caps would break over it.  He headed it to a point west of Grand Marias in order that he might be better able to ride the crest of the seas, praying and hoping that when they reached the shore, which he hoped would be before dark, they would find a place to land in safety.

I wish to state here that I have seen the north shore of Lake Superior.  After leaving Duluth, going east along the north shore, one will find a very rugged shore, ledges of rock from 20 to 200 feet in height standing perpendicularly along the shore line.  In these rock ledges are great caves that have been fashioned by angry waves of Lake Superior during centuries.  To fully appreciate this story it is well for the reader to know a little concerning the dangers of Lake Superior.  Salt-water sailors who have been on the five oceans prefer to be on the ocean in a storm rather than on Lake Superior.  The fact that Lake Superior is more dangerous than the oceans is conceded by sailors generally, particularly in the fall of the year.  In the ocean, the billows are longer with great spaces between them; while on Lake Superior they are short, choppy, and heavy; and create much more hazard.

Night overtook the missionary and the guide before they reached the north shore; the wind became stronger and the billows higher.  The only light they had to guide them was the distant glimmer of the stars, and the guide was able to keep his course by keeping his craft nosed in the direction of the North Star.

After many hours of hard pulling on the oars, the guide knew that they were reaching the shore because he was familiar with the shoreline, and knew that the noise which was all but deafening was created by the breakers dashing against the rock-bound shore.

The guide said to his companion, “No-say, we are nearing the shore, but I am sure we are many miles from Grand Marias.  There is no river known in this region and on account of the precipitous formation of the shore line, we have no place to land in safety in this storm.”  Bishop Baraga answered, “My son, do as I say, and we will make a landing in safety.”  The guide obeyed.  His hand were blistered; his strength was leaving his body, but he managed to keep up his struggle against the angry seas.  The back-wash created by the billows dashing against the perpendicular rocks of the shore-line made conditions more perilous.  The guide said, “Father, there is nothing but certain death ahead of us.  We cannot survive this storm.”  The noise was so great that it was impossible for the two voyagers to hear each other without shouting, though they were only fifteen or sixteen feet apart; but the Bishop simply said, “Louis, keep going straight ahead.”

Much water had entered their little boat, and it was coming in faster now that they were nearing the ledges of rocks, and the seas, augmented by the back-wash, were becoming rougher, so that destruction seemed imminent.  Then amid the tumult and tossing of the boat upon the choppy seas, the boat was suddenly driven from the rough sea into tranquil waters, seemingly guided by some supernatural power.  The guide knew that the craft was not being directed by his efforts, and that they were nearing the shore with each sweep of the waves.  To his amazement, the boat grounded, and by feeling the depth of the water with his oar he knew that they were in shallow water, but he was unable to determine whether they were in a cave or at the mouth of some stream.

“Father,” Louis cried delightedly, “it seems to me that we are in a cave or at the mouth of some stream, because by feeling around with my oar I can feel a current coming from the land direction.”  The missionary then told him to take out their bundle, and light the lantern so that they could see where they were and explore their surroundings.

After lighting the lantern, they made a survey of their surroundings and found that they were at the mouth of a large stream.  They climbed out of the river and to higher ground, and there made their camp for the night.

The following morning, Bishop Baraga told his guide that they would stay there that day, that they would construct and erect a cross in token of thanksgiving to God for his help and guidance to safety.  So, all that day they worked.  They cut down some large cedar trees and erected a large cedar cross, which they set up on the shore at the mouth of the stream.  The next morning Bishop Baraga and his guide went down to the site of the cross they had erected, and again offered thanks to God for their safe deliverance.  The missionary told his guide: “Hereafter this stream shall be known as “Cross River”.  It has been thus known from that time on.

About twenty or twenty-five years ago, a large number of people from Duluth, Superior, and other towns and cities in the Lake Superior region, regardless of creed, made a trip to Cross River and erected a substantial cross there in place of the old cedar cross set up by Bishop Baraga and his guide, Louis Gordon, in thanksgiving to God for the wonderful guidance and loving care of his servants who landed safely at the mouth of this stream after such a perilous voyage.

Louison Gordon, Sr. moved from La Pointe to Red Cliff later in life.

Bishop Baraga stopped at Superior on their way back from the North Shore.  They did not venture another lake-crossing.  This zealous Lake Superior Chippewa Indian Missionary died at Marquette, Michigan, on January 19, 1868.

Robert Stuart was a top official in Astor’s American Fur Company in the upper Great Lakes region. Apparently, it was not a conflict of interest for him to also be U.S. Commissioner for a treaty in which the Fur Company would be a major beneficiary.

A gentleman who has recently returned from a visit to the Lake Superior Indian country, has furnished us with the particulars of a Treaty lately negotiated at La Pointe, during his sojourn at that place, by ROBERT STUART, Esq., Commissioner of Indian Affairs for the district of Michigan, on the part of the United States, and by the Chiefs and Braves of the Chippeway Indian nation on their own behalf and their people.  From 3 to 4000 Indians were present, and the scene presented an imposing appearance.  The object of the Government was the purchase of the Chippeway country for its valuable minerals, and to adopt a policy which is practised by Great Britain, i.e. of keeping intercourse with these powerful neighbors from year to year by paying them annuities and cultivating their friendship.  It is a peculiar trait in the Indian character of being very punctual in regard to the fulfillment of any contract into which they enter, and much dissatisfaction has arisen among the different tribes toward our Government, in consequence of not complying strictly to the obligations on their part to the Indians, in the time of making the payments, for they are not generally paid until after the time stipulated in the treaty, and which has too often proven to be the means of losing their confidence and friendship.

On the 30th of September last, Mr. Stuart opened the Council, standing himself and some of his friends under an awning prepared for the occasion, and the vast assembly of the warlike Chippeways occupying seats which were arranged for their accommodation.  A keg of Tobacco was rolled out and opened as a present to the Indians, and was distributed among them; when Mr. Stuart addressed them as follows:-

The Passenger Pigeon (Ectopistes migratorius) was a metaphor for infinite abundance in 1842.  In less than 75 years, the species would be extinct.  What that means for Stuart’s metaphor is hard to say (Biodiversity Heritage Library).
The chiefs who had been to Washington were the St. Croix chiefs Noodin (pictured below) and Bizhiki. They were brought to the capital as part of a multi-tribal delegation in 1824, which among other things, toured American military facilities.

I am very glad to meet and shake hands with so many of my old friends in good health; last winter I visited your Great Father in Washington, and talked with him about you.  He knows you are poor and have but little for your women and children, and that your lands are poor.  He pities your condition, and has sent me here to see what can be done for you; some of your Bands get money, goods, and provisions by former Treaty, others get none because the Great Council at Washington did not think your lands worth purchasing.  By the treaty you made with Gov. Cass, several years ago, you gave to your lands all the minerals; so the minerals belong no longer to you, and the white men are asking him permission to take the minerals from the land.  But your Great Father wishes to pay you something for your lands and minerals before he will allow it.  He knows you are needy and can be made comfortable with goods, provisions, and tobacco, some Farmers, Carpenters to aid in building your houses, and Blacksmiths to mend your guns, traps, &c., and something for schools to learn your children to read and write, and not grow up in ignorance.  I hear you have been unpleased about your Farmers and Blacksmiths.  If there is anything wrong I wish you would tell me, and I will write all your complaints to your Great Father, who is ever watchful over your welfare.  I fear you do not esteem your teachers who come among you, and the schools which are among you, as you ought.  Some of you seem to think you can learn as formerly, but do you not see that the Great Spirit is changing things all around you.  Once the whole land was owned by you and other Indian Nations.  Now the white men have almost the whole country, and they are as numerous as the Pigeons in the springYou who have been in Washington know this; but the poor Indians are dying off with the use of whiskey, while others are sent off across the Mississippi to make room for the white men.  Not because the Great Spirit loves the white men more than the Indians, but because the white men are wise and send their children to school and attend to instructions, so as to know more than you do.  They become wise and rich while you are poor and ignorant, but if you send your children to school they may become wise like the white men; they will also learn to worship the Great Spirit like the whites, and enjoy the prosperity they enjoy.  I hope, and he, that you will open your ears and hearts to receive this advice, and you will soon get great light.  But said he, I am afraid of you, I see but few of you go to listen to the Missionaries, who are now preaching here every night; they are anxious that you should hear the word of the Great Spirit and learn to be happy and wise, and to have peace among yourselves.

The 1837 Treaty of St. Peters was mostly negotiated by Maajigaabaw or “La Trappe” of Leech Lake and other chiefs from outside the territory ceded by that treaty.  The chiefs from the ceded lands were given relatively few opportunities to speak.  This created animosity between the Lake Superior and Mississippi Bands. 

Your Great Father is very sorry to learn that there are divisions among his red children.  You cannot be happy in this way.  Your Great Father hopes you will live in peace together, and not do wrong to your white neighbors, so that no reports will be made against you, or pay demanded for damages done by you.  These things when they occur displease him very much, and I myself am ashamed of such things when I hear them.  Your Great Father is determined to put a stop to them, and he looks that the Chiefs and Braves will help him, so that all the wicked may be brought to justice; then you can hold up your heads, and your Great Father will be proud of you.  Can I tell him that he can depend upon his Chippeway children acting in this way.

One other thing, your Great Father is grieved that you drink whiskey, for it makes you sick, poor, and miserable, and takes away your senses.  He is determined to punish those men who bring whiskey among you, and of this I will talk more at another time.

Stuart would become irritated after the treaty when the Ojibwe argued they did not cede Isle Royale in 1842. This lead to further negotiations and an addendum in 1844.  The Grand Portage Band, who lived closest to Isle Royale, was not party to the 1842 negotiations.

When I was in New York about three moons ago I found 800 blankets which were due you last year, which by some mismanagement you did not get.  Your Great Father was very angry about it, and wished me to bring them to you, and they will be given you at the payment.  He is determined to see that you shall have justice done you, and to dismiss all improper agents.  He despises all who would do you wrong.  Now I propose to buy your lands from Fond du Lac, at the head of Lake Superior, down Lake Superior to Chocolate River near Grand Island, including all the Islands in the limits of the United States, in the Lake, making the boundary on Lake Superior about 250 miles in extent, and extending back into the country on Lake Superior about 100 miles.  Mr. Stuart showed the Chiefs the boundary on the map, and said you must not suppose that your Great Father is very anxious to buy your lands, the principal object is the minerals, as the white people will not want to make homes upon them.  Until the lands are wanted you will be permitted to live upon them as you now do.  They may be wanted hereafter, and in this event your Great Father does not wish to leave you without a home.  I propose that the Fond du Lac lands and the Sandy Lake tract (which embrace a tract 150 miles long by 100 miles deep) be left you for a home for all the bands, as only a small part of the Fond du Lac lands are to be included in the present purchase.  Think well on the subject and counsel among yourselves, but allow no black birds to disturb you, your Great Father is now willing and can do you great good if you will, but if not you must take the consequences.  To-morrow at the fire of the gun you can come to the Council ground and tell me whether the proposal I make in the name of your Great Father is agreeable to you; if so I will do what I can for you, you have known me to be your friend for many years.  I would not do you wrong if I could, but desire to assist you if you allow me to do so.  If you now refuse it will be long before you have another offer.

October 1st.  At the sound of the Cannon the Council met, and when all were ready for business, Shingoop, the head Chief of the Fond du Lac band, with his 2d and 3d Chiefs, came forward and shook hands with the Commissioner and others associated with him, then spoke as follows:

Zhingob (Balsam), also known as Nindibens, signed the 1837, 1842, and 1854 treaties as chief or head chief of Fond du Lac. The Zhingob on earlier treaties is his father. See Ely, ed. Schenck, The Ojibwe Journals of Edmund F. Ely

Naagaanab (Foremost Sitter) is likely the 2nd Fond du Lac chief mentioned here.

My friend, we now know the purpose you came for and we don’t want to displease you.  I am very glad there are so many Indians here to hear me.  I wish to speak of the lands you want to buy of me.  I don’t wish to displease the Traders.  I don’t wish to displease the half-breeds; so I don’t wish to say at once, right off.  I want to know what our Great Father will give us for them, then I will think and tell you what I think.  You must not tell a lie, but tell us what our Great Father will give us for our lands.  I want to ask you again, my Father.  I want to see the writing, and who it is that gave our Great Father permission to take our minerals.  I am well satisfied of what you said about Blacksmiths, Carpenters, Schools, Teachers, &c., as to what you said about whiskey, I cannot speak now.  I do not know what the other Chiefs will say about it.  I want to see the treaty and the name of the Chiefs who signed.  The Chief answered that the Indians had been deceived, that they did not so understand it when they signed it.

Mr. Stuart replied that this was all talk for nothing, that the Government had a right to the minerals under former treaty, yet their Great Father wishes now to pay for the minerals and purchase their lands.

The Chief said he was satisfied.  All shook hands again and the Chief retired.

The next Chief who came forward was the “Great Buffalo” Chief of the La Pointe band.  Had heavy epaulettes on his shoulders and a hat trimmed with tinsel, with a heavy string of bear claws about his neck, and said:-

“Big Buffalo (Chippewa),” 1832-33 by Henry Inman, after J.O. Lewis (Smithsonian).

My father, I don’t speak for myself only, but for my Chiefs.  What you said here yesterday when you called us your children, is what I speak about.  I shall not say what the other Chief has said, that you have heard already.

He then made some remarks about the Missionaries who were laboring in their country and thought as yet, little had been done.  About the Carpenters, he said, that he could not tell how it would work, as he had not tried it yet.

We have not decided yet about the Farmers, but we are pleased at your proposal about Blacksmiths.  Can it be supposed that we can complete our deliberations in one night.  We will think on the subject and decide as soon as we can.

The great Antonaugen Chief came next, observing the usual ceremony of shaking hands, and surrounded by his inferior Chiefs, said:-

The great Ontonagon Chief is almost certainly Okandikan (Buoy), depicted here in a reproduction of an 1848 pictograph carried to Washington and reproduced by Seth Eastman.  Okandikan is depicted as his totem symbol, the eagle (largest, with wing extended in the center of the image).

My father and all the people listen and I call upon my Great Father in Heaven to bear witness to the rectitude of my intentions.  It is now five years since we have listened to the Missionaries, yet I feel that we are but children as to our abilities.  I will speak about the lands of our band, and wish to say what is just and honorable in relation to the subject.  You said we are your children.  We feel that we are still, most of us, in darkness, not able fully to comprehend all things on account of our ignorance.  What you said about our becoming enlightened I am much pleased; you have thrown light on the subject into my mind, and I have found much delight and pleasure thereby.  We now understand your proposition from our Great Father the President, and will now wait to hear what our Great Father will give us for our lands, then we will answer.  This is for the Antannogens and Ance bands.

Mr. Stuart now said, that he came to treat with the whole Chippeway Nation and look upon them all as one Nation, and said

I am much pleased with those who have spoken; they are very fine orators; the only difficulty is, they do not seem to know whether they will sell their lands.  If they have not made up their minds, we will put off the Council.

Apishkaagaagi (Magpie/”White Crow”), was the son of the prominent 18th-century Lac du Flambeau chief Giishkiman.  The United States found White Crow more difficult to work with than his brother, Mozobodo, or his son Aamoons.

Lac du Flambeau Chief, “the Great Crow,” came forward with the strict Indian formalities but had but little to say, as he did not come expecting to have any part in the treaty, but wished to receive his payment and go home.

The 2d Chief of this band wished to speak.  He was painted red with black spots on each cheek to set off his beauty, his forehead was painted blue, and when he came to speak, he said:-

We are not able to determine, with certainty, which chief is speaking here. Metaakozige (Pure Tobacco) and Zhiimaaginish (Soldier) signed the treaty as second chiefs, but this could also be one of the chiefs listed under Wisconsin River or Lake Bands. These were smaller villages sometimes lumped in with Lac du Flambeau.

What the last Chief has said is all I have to say.  We will wait to hear what your proposals are and will answer at a proper time.

Next came forward “Noden,” or the “Great Wind,” Chief of the Mill Lac band, and said:-

Noodin (Wind) is mentioned here as representing the Mille Lacs Band, though his village was usually on Snake River of the St. Croix.

I have talked with my Great Father in Washington.  It was a pity that I did not speak at the St. Peters treaty.  My father, you said you had come to do justice.  We do not wish to do injustice to our relations, the half-breeds, who are also our friends.  I have a family and am in a hurry to get home, if my canoes get destroyed I shall have to go on foot.  My father, I am hurry, I came for my payment.  We have left our wives and children and they are impatient to have us return.  We come a great distance and wish to do our business as soon as we can.  I hope you will be as upright as our former agent.  I am sorry not to see him seated with you.  I fear it will not go as well as it would.  I am hurry.

Mr Stuart now said that he considered them all one nation, and he wished to know whether they wished to sell their lands; until they gave this answer he could do nothing, and as it regards any thing further he could say nothing, and said they might now go away until Monday, at the firing of the Cannon they might come and tell him whether they would sell their country to their Great Father.

(Treaty with the Chippeways Concluded.)

Monday morning three guns were fired as a signal to open the Treaty. When all things were in readiness, Mr. Stuart said:

I am glad you have now had time for reflection, and I hope you are now ready like a band of brothers to answer the question which I have proposed.  I want to see the Nation of one heart and of one mind.

Shingoop, Chief of the Fond du Lac band, came forward with full Indian ceremony, supported on each side by the inferior Chiefs.  He addressed the Chippeway nation first, which was not fully interpreted; then he turned to the Commissioner and said:

The Treaty of La Pointe (1842) was largely opposed by the mix-blood Ojibwe because it provided far less for them ($15,000) than the 1837 Treaty had ($100,000), and was not in the form of direct payments. 

in this Treaty which we are about to make, it is in my heart to say that I want our friends the traders, who have us in charge provided for.  We want to provide also for our friends the half-breeds – we wish to state these preliminaries.  Now we will talk of what you will give us for our country.  There is a kind of justice to be done towards the traders and half-breeds.  If you will do justice to us, we are ready to-morrow to sign the treaty and give up our lands.  The 2d Chief of the band remarked, that he considered it the understanding that the half-breeds and traders were to be provided for.

The Great Buffalo, of La Pointe band, and his associate Chiefs came next, and the Buffalo said:

For the last 170 years, the Lake Superior Ojibwe leadership has argued that through deceit, inadequate translation, and/or cultural misunderstanding, the chiefs did not fully understand the meaning of words like cession, sale, removal, etc. in 1842.  For courts and historians, this can be difficult to square with the chiefs’ clear knowledge of the fates of other tribal nations and the use of language like “sell my lands” in their own letters and documents of the time. However, since these speeches, seem largely concerned with getting home quickly, and primarily emphasize the concerns of traders and mix bloods (almost as if the treaty were an afterthought for the chiefs themselves)–it is very difficult to argue that they understood that these negotiations could lead to the permanent loss of millions of acres and subject their bands to deadly removal efforts.   

My Father, I want you to listen to what I say.  You have heard what one Chief has said.  I wish to say I am hurry on account of keeping so many men and women here away from their homes in this late season of the year, so I will say my answer is in the affirmative of your request; this is the mind of my Chiefs and braves and young men.  I believe you are a correct man and have a heart to do justice, as you are sent here by our Great Father, the President.  Father, our traders are so related to us that we cannot pass a winter without them.  I want justice to be done them.  I want you and our Great Father to assist us in doing them justice, likewise our half-breed children – the children of our daughters we wish provided for.  It seems to me I can see your heart, and you are inclined to do so.  We now come to the point for ourselves.  We wish to know what you will give us for our country.  Tell us, then we will advise with our friends.  A part of the Antaunogens band are with me, the other part are turned Christians and gone with the Methodist band, (meaning the Ance band at Kewawanon) these are agreed in what I say.

The Bird, Chief of the Ance band, called Penasha, came forward in the usual form and said:

Bineshiinh (Bird) signed as first chief of L’Anse.

My Father, now listen to what I have to say.  I agree with those who have spoken as far as our lands are concerned.  What they say about our traders and half-breeds, I say the same.  I speak for my band, they make use of my tongue to say what they would say and to express their minds.  My Father, we listen to what you will offer for our country, then we will say what we have to say.  We are ready to sell our country if your proposals are agreeable.  All shook hands – equal dignity was maintained on each side – there was no inclination of the head or removing the hat – the Chiefs took their seats.

The White Crow next appeared to speak to the Great Father, and said:-

“It appears you are not anxious to buy the lands where I live”
White Crow is apparently unaware that in the eyes of the United States, his lands, (Lac du Flambeau) were already sold five years earlier at St. Peters.  Clearly, the notion of buying and selling land was not understood by him in the same way it was understood by Stuart.

Listen to what I say.  I speak to the Great Father, to the Chiefs, Traders, and Half-breeds.  You told us there was no deceit in what you say.  You may think I am troublesome, but the way the treaty was made at St. Peters, we think was wrong.  We want nothing of the kind again.  We think you are a just man.  You have listened to those Chiefs who live on Lake Superior.  What I say is for another portion of country.  It appears you are not anxious to buy the lands where I live, but you prefer the mineral country.  I speak for the half-breeds, that they may be provided for: they have eaten out of the same dish with us: they are the children of our sisters and daughters.  You may think there is something wrong in what I say.  As to the traders, I am not the same mind with some.  The old traders many years ago, charged us high and ought to pay us back, instead of bringing us in debt.  I do not wish to provide for them; but of late years they have had looses and I wish those late debts to be paid.  We do not consider that we sell our lands by saying we will sell them, so we consent to sell if your proposals are agreeable.  We will listen and hear what they are.

Several others of the Chiefs spoke well on the subject, but the substance of all is contained in the above.

Hole-in-the-day, who is at once an orator and warrior, came forward; he had an Arkansas tooth pick in his hand which would weigh one or two pounds, and is evidently the greatest and most intelligent man in the nation, as fine a form of body, head and face, as perhaps could be found in any country.

Bagone-giizhig (The elder Hole In The Day) was highly influential due to his war exploits. However, as one of the Mississippi chiefs who pushed the St. Peters Treaty, and for his close connection to Mississippi River trading interests, he wasn’t universally loved in the Lake Superior country.

Father, said he, I arise to speak. I have listened with pleasure to your proposal.  I have come to tie the knot.  I have come to finish this part of the treaty, and consent to sell our country if the offers of the President please us.  Then addressing the Chiefs of the several bands he said, the knot is now tied, and so far the treaty is complete, not to be changed.

Zhaagobe (“Little” Six) signed as first chief from Snake River, and he is almost certainly the “Big Six” mentioned here. Several Ojibwe and Dakota chiefs from that region used that name (sometimes rendered in Dakota as Shakopee).

Big Six now addressed the whole Nation in a stream of eloquence which called down thunders of applause; he stands next to Hole-in-the-day in consequence and influence in the nation.  His motions were graceful, his enunciation rather rapid for a fine speaker.  He evidently possesses a good mind, though in person and form he is quite inferior to Hole-in-the-day.  His speech was not interpreted, but was said to be in favor of selling the Chippeway country if the offer of the Government should meet their expectations, and that he took a most enlightened view of the happiness which the nation would enjoy if they would live in peace together and attend to good counsel.

Mr. Stuart now said,

I am very happy that the Chippewa nation are all of one mind.  It is my great desire that they should continue to for it is the only way for them to be happy and wise.  I was afraid our “White Crow” was going to fly away, but am happy to see him come back to the flock, so that you are all now like one man.  Nothing can give me greater pleasure than to do all for you I can, as far as my instructions from your Great Father will allow me.  I am sorry you had any cause to complain of the treaty at St. Peters.  I don’t believe the Commissioner intended to do you wrong, but perhaps he did not know your wants and circumstances so as to suit.  But in making this treaty we will try to reconcile all differences and make all right.  I will now proceed to offer you all I can give you for  your country at once.  You must not expect me to alter it, I think you will be pleased with the offer.  If some small things do not suit you, you can pass them over.  The proposal I now make is better than the Government has given any other nation of Indians for their lands, when their situations are considered.  Almost double the amount paid to the Mackinaw Indians for their good lands.  I offer more than I at first intended as I find there are so many of you, and because I see you are so friendly to our Government, and on account of your kind feelings for the traders and half-breeds, and because you wish to comply with the wishes of your Great Father, and because I wish to unite you all together.  At first I thought of making your annuities for only twenty years but I will make them twenty-five years.  For twenty-five years I will offer you the following and some items for one year only.

This amount will be connected with the annuity paid to a part of the bands on the St. Peters treaty, and the whole amount of both treaties will be equally distributed to all the bands so as to make but one payment of the whole, so that you will be but one nation, like one happy family, and I hope there will be no bad heart to wish it otherwise.  This is in a manner what you are to get for your lands, but your Great Father and the great Council at Washington are still willing to do more for you as I will now name, which you will consider as a kind of present to you, viz:

With regards to the claims.  I will not allow any claim previous to 1822; none which I deem unjust or improper.  I will endeavor to do you justice, and if the $75,000 is not all required to pay your honest debts, the balance shall be paid to you; and if but a part of your debts are paid your Great Father requires a receipt in full, and I hope you will not get any more credits hereafter.  I hope you have wisdom enough to see that this is a good offer.  The white people do not want to settle on the lands now and perhaps never will, so you will enjoy your lands and annuities at the same time.  My proposal is now before you.

The Fond du Lac Chief said, we will come to-morrow and give our answer.

October 4th, Mr. Stuart opened the Council.

Clement Hudon Beaulieu, was about thirty at this time and working his way up through the ranks of the American Fur Company at the beginning of what would be a long and lucrative career as an Ojibwe trader.  His influence would have been very useful to Stuart as he was a close relative of Chief Gichi-Waabizheshi.  He may have also been related to the Lac du Flambeau chiefs–though probably not a grandson of White Crow as some online sources suggest.

We have now met said he, under a clear sun, and I hope all darkness will be driven away.  i hope there is not a half-breed whose heart is bad enough to prevent the treaty, no half-breed would prevent he treaty unless he is either bad at heart or a fool.  But some people are so greedy that they are never satisfied.  I am happy to see that there is one half-breed (meaning Mr. Clermont Bolio) who has heart enough to advise what is good; it is because he has a good heart, and is willing to work for his living and not sponge it out of the Indians.

We now heard the yells and war whoops of about one hundred warriors, ornamented and painted in a most fantastic manner, jumping and dancing, attended with the wild music usual in war excursions.  They came on to the Council ground and arrested for a time the proceedings. These braves were opposed to the treaty, and had now come fully determined to stop the treaty and prevent the Chiefs from signing it.  They were armed with spears, knives, bows and arrows, and had a feather flag flying over ten feet long.  When they were brought to silence, Mr. Stuart addressed them appropriately and they soon became quiet, so that the business of the treaty proceeded.  Several Chiefs spoke by way of protecting themselves from injustice, and then all set down and listened to the treaty, and Mr. Stuart said he hoped they would understand it so as to have no complaints to make afterwards.

Stuart is quoted above, “The white people do not want to settle on the lands now and perhaps never will, so you will enjoy your lands and annuities at the same time.”  Nine years later, the United States would attempt to force a removal despite minimal American settlement in the ceded territory. The Ojibwe leadership saw this as a clear broken promise.

The provisions of the treaty are the same as made in the proposals as to the amount and the manner of payment.  The Indians are to live on the lands until they are wanted by the Government.  They reserve a tract called the Fond du Lac and Sandy Lake country, and the lands purchased are those already named in the proposals.  The payment on this treaty and that of the St. Peters treaty are to be united, and equal payments made to all the bands and families included in both treaties.  This was done to unite the nation together.  All will receive payments alike.  The treaty was to be binding when signed by the President and the great Council at Washington.  All the Chiefs signed the treaty, the name of Hole-in-the-day standing at the head of the list, and it is said to be the greatest price paid for Indian lands by the United States, their situation considered, though the minerals are said to be very valuable.

Ronald Satz, on page 34 of his groundbreaking Chippewa Treaty Rights offers,Official documentation for the 1842 treaty is scanty since unlike the 1837 negotiations neither Treaty Commissioner Stuart nor Secretary Jonathan Hulbert kept a journal, or at least neither forwarded one to Commissioner of Indian Affairs Crawford.” These articles from the Green Bay paper may be the closest we get, and are therefore invaluable to understanding how the chiefs felt at the time of the 1842 Treaty.  

The Commissioner is said to have conducted the treaty in a very just, impartial and honorable manner, and the Indians expressed the kindest feelings towards him, and the greatest respect for all associated with him in negotiating the treaty and the best feelings towards their Agent now about leaving the country, and for the Agents of the American Fur Company and for the traders.  The most of them expressed the warmest kind of feelings toward the Missionaries, who had come to their country to instruct them out of the word of the Great Spirit.  The weather was very pleasant, and the scene presented was very interesting.

The legendary Gichi-miishen (Michel Cadotte, Sr.) passed away days before the 1837 Treaty of St Peters was signed.  One year later his son Michel Cadotte, Jr. and son-in-law Lyman M. Warren were both publicly arrested at the 1838 Annuity Payments in La Pointe, clouding their families’ 1827 Deed for Old La Pointe and 1834 Reinvention of La Pointe.

I have the honor to transmit the report of E. F. Ely, Esq. Sup’t of a school at Fond du Lac, Lake Superior, forwarded by Mr D. P. Bushnell, Sub agent at La Pointe, which had not been received at the time the other reports were transmitted.

Mr. Bushnell also informs me under date of the 18th Sept. that he has caused Lyman M. Warren, an American citizen, and Michel Cadotte, a half-breed, to be removed from the Indian Country, and has furnished the Dist. Attorney at Green Bay with the necessary evidence and requested him to commence suits against them, for violations of the 12th, 13th & 15th Sections of the act of June 30, 1834.  Mr Warren is now here, and suits have been instituted upon the representations of the sub-agent.  Further information will be furnished to you as soon as received.

Sir:

I have the honor to transmit enclosed herewith, a communication from Lyman M. Warren, recently of La Pointe, Lake Superior, who, upon charges of a violation of the 12th, 13th & 15th Sections of the “Act to regulate trade and intercourse with the Indian tribes &c,” was removed from the Indian Country.  Mr Warren has been long in the service of the American Fur Company at that post, and extensively engaged in Indian trade; and, from the hurried manner in which he was taken from the country, much of his business remains unsettled.  He now asks from the Department, for the reasons given in his letter, that he be permitted to return to La Pointe next Spring for the purpose only of settling his business; an indulgence which I think may be safely granted.  Mr Warren was the bearer of the information to the Dist. Attorney of the United States at this place, upon which suits were instituted against him, which fact, with that of his previous good standing and the respectability of his connection in this Territory, warrants me in the opinion that no detriment can arise to the Government from a compliance with his request.  I have also consulted with the Sub-agent at that station, Mr. Bushnell, who admits the propriety of permitting him to return to the country, for the purposes expressed in his letter, if the agent be not absent.  In case the Department should feel disposed to accede to his request, it would be well to instruct the District Attorney not to take any advantage of his absence at the Spring term of the Court, at which he is recognized to answer.

Although still unceded territory in 1838, La Pointe was attached to Crawford County when Warren and Cadotte were arrested, which is why they were brought to the county seat Prairie du Chein under jurisdiction of the court there.

Since Michel Cadotte and myself have arrived at this place and been served with process in the various suits brought against us in the name of the United States and given bail for our appearance at the May Term of the Crawford District Court in the Cases where bail was required, I have thought proper to address your Excellency in relation to the course that has been taken against me, and to request through your Excellency, some indulgence from the Department in the management of the Cases from the peculiar circumstances of my situation.

SEC. 10. And be it further enacted, That the superintendent of Indian affairs, and Indian agents and sub-agents, shall have authority to remove from the Indian country all persons found therein contrary to law; and the President of the United States is authorized to direct the military force to be employed in such removal.
SEC. 11. And be it further enacted, That if any person shall make a settlement on any lands belonging, secured, or granted by treaty with the United States to any Indian tribe, or shall survey or shall attempt to survey such lands, or designate any of the boundaries by marking trees, or otherwise, such offender shall forfeit and pay the sum of one thousand dollars. And it shall, moreover, be lawful for the President of the United States to take such measures, and to employ such military force, as he may judge necessary to remove from the lands as aforesaid any such person as aforesaid.
SEC. 12. And be it further enacted, That no purchase, grant, lease, or other conveyance of lands, or of any title or claim thereto, from any Indian nation or tribe of Indians, shall be of any validity in law or equity, unless the same be made by treaty or convention entered into pursuant to the constitution. And if any person, not employed under the authority of the United States, shall attempt to negotiate such treaty or convention, directly or indirectly, to treat with any such nation or tribe of Indians, for the title or purchase of any lands by them held or claimed, such person shall forfeit and pay one thousand dollars: Provided, nevertheless, That it shall be lawful for the agent or agents of any state who may be present at any treaty held with Indians under the authority of the United States, in the presence and with the approbation of the commissioner or commissioners of the United States appointed to bold the same, to propose to, and adjust with the Indians, the compensation to be made for their claim to lands within such state, which shall be extinguished by treaty.
SEC. 13. And be it further enacted, That if any citizen or other person residing within the United States or the territory thereof, shall send any talk, speech, message, or letter to any Indian nation, tribe, chief, or individual, with an intent to produce a contravention or infraction of any treaty or other law of the United States, or to disturb the peace and tranquillity of the United States, he shall forfeit and pay the sum of two thousand dollars.
SEC. 14. And be it further enacted, That if any citizen, or other person, shall carry or deliver any such talk, message, speech, or letter, to or from any Indian nation, tribe, chief, or individual, from or to any person or persons whatsoever, residing within the United States, or from or to any subject, citizen, or agent of any foreign power or state, knowing the contents thereof, he shall forfeit and pay the sum of one thousand dollars.
SEC. 15. And be it further enacted, That if any citizen or other person, residing or living among the Indians, or elsewhere within the territory of the United States, shall carry on a correspondence, by letter or otherwise, with any foreign nation or power, with an intent to induce such foreign nation or power to excite any Indian nation, tribe, chief, or individual, to war against the United States, or to the violation of any existing treaty; or in case any citizen or other person shall alienate, or attempt to alienate, the confidence of any Indian or Indians from the government of the United States, he shall forfeit the sum of one thousand dollars.

Your Excellency is aware that I was arrested at Lapointe on Lake Superior among the Chippewa Indians by a Military force, without legal process, and brought from thence by the way of the Sault Ste Marys, Mackinac and Green Bay to Fort Winebago from which place I came voluntarily and brought to the complaint against me to your Excellency that after giving bail in one Case at Mineral Point I came to this place whither the Deputy Marshall was sent to execute other process on me and Michel Cadotte.  I was arrested and brought away from Lapointe at a time when private business of the greatest importance required my presence there, and my arrest and removal and consequent losses have almost ruined me.  On my way I was robbed of upwards of One Thousand Dollars in Cash which is one of the consequences to me of the proceedings that have been commenced against me.  I believe that your Excellency is fully aware that if I had been disposed to disregard the laws and authorities of the Country and to set them at defiance the force which was sent for me was not sufficient to bring me away.  In fact the Indians in the vicinity were disposed to resists and to prevent my removal, and would have done so if I had not used my influence to restrain them.  I mention this as an evidence of my disposition to submit to the laws and authorities of the Government, rather than to oppose or violate either.

I have been a Trader in extensive business among the Chippeways on Lake Superior for upwards of twenty one years, an can appeal with confidence to all intelligent Gentlemen who have been acquainted with my course of conduct throughout that period for testimony that I have always conformed my conduct to the laws of Congress, and the regulations of the Department, when known and understood.  I have never knowingly violated either, and if I have ever in any case gone contrary to either, it has been when the law or regulation had not been made known at my remote and far distant station.

No one could expect that so far removed as I have been from settlements and civilization with so little intercourse with either, I could be so well and promptly made acquainted with the legislation and regulations of the Government as those who enjoyed the advantage of a residence within the more immediate sphere of its action and opperations.  In the present Case I feel perfectly conscious, that I am free from all blame, and believe that it will be found upon investigation, that the proceedings against me originated in malice.

It is expected I believe that the Half breeds of the Chippeways on Lake Superior will be paid their share of the money donated to them by Treaty, some time early next Spring.  It is of great importance to me and to others that I should be present at that payment.  I have of my own a large family of children who are interested in the expected payment.  Besides I am guardian of an estate which will require my personal presence at that place, in order that it may be settled.

Cadotte is also interested in the payment on his own account, and that of his children.  It will be impossible for us to go up in the Spring and return to the Spring terms of the Court at Mineral Point and this place.  I would therefore request it as a favor of the Department, if sufficient reason does not appear for dismissing the prosecutions altogether, that I may be permitted with Cadotte to attend at La Pointe in the next Spring season at the contemplated payment, or when ever the same may be made, and that no steps may be taken in the prosecution of the suits against us in our absence, and that the Attorney for the Territory may be directed not to take any default against us in any of the Cases either for want of bail, or plea, or other necessary propositions for our defense, while we may be absent on such business.

I hope that your Excellency will perceive the great importance to me of obtaining this indulgence, and sufficient reason to induce the kind interposition of your Excellency’s good offices to have it granted to me.

To enable me to reply to the District Attorney’s letter I shall be obliged by your informing me at your earliest convenience, whether you wish any particular [directions?] given to him on the subject.  Please return the District Attorney’s letter with its inclosure.

The 1826 Treaty of Fond du Lac originally contained a list of Mixed Blood tribal members that would each be given a square mile (aka a section) of land, including 14 members of the Cadotte/Warren family.  Unfortunately that list was omitted from the Treaty by Senate before ratification in 1827.  The 1827 Deed for Old La Pointe seemed to have been created by the Cadotte/Warren family at La Pointe in response.

1827 Deed for Old La Pointe from Madeline and Michel Cadotte, Sr. to Lyman M. Warren for 2,000 acres of unceded tribal land on Madeline Island to be held in trust for the Cadotte/Warren grandchildren and future generations.

A prosecution was commenced last fall by the Indian Department against Lyman M. Warren, a licensed Trader at Lapointe, Lake Superior and a half Indian by the name of Michel Cadotte, for accepting of a verbal gift to Warren by the Indians of a part of an Island in Lake Superior.  This gift I believe was intended to be in lieu of 14 sections of land given by the same Indians to the wife of Warren (an Indian woman, and his children, which had been reserved to them in the Treaty of Fond du Lac, but which was I am informed, stricken out, with other reservations of land, by the Senate.

It appears that Warren was ignorant of the act of Congress on this subject, and that so soon as he was informed, he desisted.  Some months afterwards, and without anything new having secured, the sub-agent (then 300 miles from Lapointe) obtained a military force to be sent from Fort Brady to arrest Warren and his interpreter Cadotte.  They made no resistance but voluntarily came with the soldiers to the Sault Ste Marie, and thence to Mineral Point 600 miles further.

American brothers Lyman M. Warren and Truman A. Warren both married to daughters of Madeline and Michel Cadotte, Sr. The Cadotte/Warren grandchildren were still young children when signing the 1837 Petitions from La Pointe to the President regarding Treaty rights for Chippewa Mixed Bloods.

Mr. Warren has been a Trader in that Country for the last 20 years, and I have personally known him there since the year 1820.  During this long period he has been much respected as an upright Trader, submissive to the laws, and at all times disposed to extend the power of this government over the Northern Indians, who it is well known have been most inclined to visit and listen to the British authorities.  I do not think there is another Indian Trader in the North West who has a greater influence with those Tribes than Mr. Warren.

The sub-agent, Mr. Bushnell, was a stranger in that country, but recently appointed, and, I cannot but think, has caused Mr. Warren to be arrested without a due examination of the facts of the case, or without giving a proper consideration to the effect it will be likely to have with the Indians of that country.

If Mr. Warren is compelled to defend this suit, whether it results in his favour or not, it must ruin him and his family, and I think the government will lose more than it will gain by continuing the prosecution.

From my knowledge of the parties, the facts of the case and the condition of the country I would respectfully recommend that the District Attorney be directed to discontinue the prosecutions against Warren & Cadotte upon the payment of costs and a stipulation not to prosecute Bushnell and the Commanding Officer at Fort Brady.  I have no hesitation in expressing to you the opinion, that if the prosecution is continued the judgement of the Court will be in favour of the defendants.

Sir

I have the honor to acknowledge the receipt of your communication dated 7 ultimo enclosing an extract from a Resolution of the House of the Representatives of the 19th of March, 1838.  No case of intermeddling by any foreign government on the officers, or subject thereof with the Indians under my charge or any others, directly , or indirectly, has come to my knowledge.  It is believed that the English government has been in the Habit of distributing presents at a point on Lake Huron below Drummonds Island to the Chippewa for a series of years.

The Indians from this region, until recently, visited that place for their share of the annual distribution.  But the Treaty made last summer between them and the United States, and the small distribution of presents that has been made within the Last Year, under the direction of our government, have had the effect to permit any of them from visiting, the English Territory this year.  These Indians have generally manifested a desire to live upon terms of friendship with the American people.  All of the Chiefs from the region of Lake Superior have expressed a desire to visit the seat of Gov’t where none of them have yet been.  There is no doubt, but such a visit with the distribution of a few presents among them would be productive: of much good, and render their attachment to our Gov’t still stronger.

Speech of Jean B. DuBay,

a half breed Chippewa, on behalf of the half breeds assembled in a numerous body at the United States Sub Indian Agency office at La Pointe, on the 15th day of August 1838.

Father.  We have come to you for the purpose of speaking on the subject of the murder that was committed two years ago by an Indian on one of our Brothers.  I allude to Alfred Aitken.  We have always considered ourselves Subject to the Laws of the United States and have consequently relied upon their protection. But it appears by the decision of the United Sates court in this case.  That it was an Indian Killed an Indian, on Indian ground, and died not therefore come under its jurisdiction,” that we have hitherto laboured under a delusion, and that a resort to the laws can avail nothing.   We come therefore to you, at the agent of the Government here, to tell you that we have councilled with the Indians and, have declared to them and we have solemnly pledged ourselves in your presence, to each other, that we will enforce in the Indian Country, the Indian Law, Blood for Blood.

We pay taxes, and in the Indian Country are held amenable to the Laws, but appeal to them in vain for protection.  Sir we will protect ourselves.  We take the case into our own hands.  Blood shall be shed!  We will have justice and who can be answerable for the consequences?  Our brother was a gentlemanly young man.  He was educated at a Seminary in Louville in the State of New York.  He was dear to us.  We remember him as the companion of our childhood.  The voice of his Blood now cries to us from the ground for vengence!  But the stain left by his you shall be washed out by one of a deeper dye!

For injuries committed upon the persons or property of whites, although within the Indian Country we are still willing to be held responsible to the Laws of the United States, notwithstanding the decision of a United States Court that we are Indians.  And for like injuries committed upon us by whites we will appeal to the same tribunal.

Sir our attachments to the American Government and people was great.  But they have cast us off.  The Half breeds muster strong on the northwestern frontier & we Know no distinction of tribes.  In one thing at least we are all united.  We might muster into the service of the United States in case of a war and officered by Americans would compose in frontier warfare a formidable corps.  We can fight the Indian or white man, in his own manner, & would pledge ourselves to Keep peace among the different Indian tribes.

Sir we will do nothing rashly.  We once more ask from your hands the murder of Mr. Aitken.  We wish you to represent our case to the President and we promise to remain quiet for one year, giving ample time for his decision to be made Known.  Let the Government extend its protection to us and we will be found its staunchest friends.  If it persists in abandoning us the most painful consequences may ensue.

Sir we will listen to your reply, and shall be Happy to avail ourselves of your advice.

 

Reply of the Subagent.

My friends, I have lived several years on the frontier & have Known many half breeds.  They have to my Knowledge paid taxes, & held offices under State, Territorial, and United States authorities, been treated in every respect by the Laws as American Citizens; and I have hitherto supposed they were entitled to the protection of the Laws.  The decision of the court is this case, if court is a virtual acknowledgement of your title to the Indians as land, in common with the Indians & I see no other way for you to obtain satisfaction then to enforce the Indian Law.  Indeed your own safety requires it.  in the meantime I think the course you have adopted, in awaiting the results of this appeal is very proper, and cannot injure your cause although made in vain.  At your request I will forward the words of your speaker, through the proper channel to the authorities at Washington.  In the event of your being compelled to resort to the Indian mode of obtaining satisfaction it is to be hoped you will not wage an indiscriminate warfare.  If you punish the guilty only, the Indians can have no cause for complaint, neither do I think they will complain.  Any communication that may be made to me on this subject I will make Known to you in due time.

I have the honour to submit to you a petition from the Half-breeds of the Chippewa Nation, which has just been received.

It must be obvious to you Sir, that the place from which the Indian Trade is prosecuted in the Country of that Nation is the proper place to collect the Half Breeds to receive their allowance under the Treaty.  A very large number being employed by the Traders, if they are required to go to any other spot than La Pointe, they must lose their employment for the season.  Three fourths of them visit La Pointe annually, in the course of the Trade.  Very few either live or are employed on the St. Croix.

As an act of justice, and of humanity, to them I respectfully recommend that the payment be made to them under the Treaty at La Pointe.

The Petition of the Half Breeds of the Chippewa nation respectfully shareth.

That we, Half Breeds of the Chippewa Nation, have recently learned, that the payment of the sum granted to the Chippewa Half Breeds, by virtue of the Treaty of 29th July 1837, has been deferred to next Spring, and, that the St Croix River has been selected as the place of payment.

That the delay in not having received our share of the above grant to the Chippewa Half Breeds, last summer, has caused us much loss, by keeping us from our regular vocations for several months, and by leaving many of us without means of support during winter, and that the arrangement of having the payment made next spring on the St Croix, will oblige us to perform a long and expensive Journey, leaving our families in our absence without any means of subsistance, and depriving us of all chance of being employed either in the Indian Trade or at fishing, by which means alone, we are able to earn our daily bread.

Your Petitioners with great deference and implicit submission to the pleasure of the President of the United States, respectfully pray, that an alteration may be made in the place assigned for payment and that Lapointe on Lake Superior may be fixed upon as the place of payment that place being the annual rendezvous of the Chippewa Half Breeds and the Chippewa Indians Traders, by whom we are employed.

And your Petitioners as in duty bound shall ever pray &c. &c.

To the President of the United States of America

The humble petition of the undersigned Chippewa Half-Breeds citizens of the United Sates, respectfully Shareth:

Bizhiki (Buffalo), Dagwagaane (Two Lodges Meet), and Jechiikwii’o (Snipe, aka Little Buffalo) signed the 1837 Treaty of St Peters for the La Pointe Band.

That, your petitioners having lately heard that a Treaty had been concluded between the Government of the United Sates and the Chippewa Indians at St Peters, for the cession of certain lands belonging to that tribe:

1837 Treaty of St Peters:
ARTICLE 3.

“The sum of one hundred thousand dollars shall be paid by the United States, to the half-
breeds of the Chippewa nation, under the direction of the President. It is the wish of the
Indians that their two sub-agents Daniel P. Bushnell, and Miles M. Vineyard, superintend
the distribution of this money among their half-breed relations.”

That, the said Chippewa Indians X, having a just regard to the interest and welfare of their Half Breed brethren, did there and then stipulate; that, a certain sum of money should be paid once for all unto the said Half-Breeds, to satisfy all claim they might have on the lands so ceded to the United States.

That, your petitioners are ignorant of the time and place where such payment is to be made.

That the great majority of the Half-Breeds entitled to a distribution of said sum of money, are either residing at La Pointe on Lake Superior, or being for the most part earning their livelihood from the Traders, are consequently congregated during the summer months at the aforesaid place.

Your petitioners humbly solicit their father the President, to take their case into consideration, and not subject them to a long and costly journey in ordering the payments to be made at any inconvenient distance, but on the contrary they trust that in his wisdom he will see the justice of their demand in requiring he will be pleased to order the same to be distributed at Lapointe agreeable to their request.

Your petitioners would also intimate that, although they are fully aware that the Executive will make a judicious choice in the appointment of the Commissioners who will be selected to carry into effect the Provisions of said Treaty, yet, they would humbly submit to the President, that they have full confidence in the integrity of D. P. Bushnell Esqr. resident Indian Agent for the United States at this place and Lyman M Warren Esquire, Merchant.

Your petitioners entertain the flattering hope, that, their petition will not be made in vain, and as in duty bound will ever pray.

I have the honor to inclose the talk of “Buffalo,” a principal chief of the Chippewa Indians in the vicinity of La Pointe, delivered on the 9th Dec’r last before Mr Bushnell, sub-agent of the Chippewas at that place. Mr. Bushnell remarks that the speech is given with as strict an adherence to the letter as the language will admit, and has no doubt the sentiments expressed by this Chief accord with those of most of the half-breeds and Indians in that place of the Country. The “Buffalo” is a man of great influence among his tribe, and very friendly to the whites.

Speech of the Buffalo principal Chief at Lapointe

Father I told you yesterday I would have something to say to you today. What I say to you now I want you to write down, and send it to the Great American Chief that we saw at St Peters last summer, (Gov. Dodge). Yesterday, I called all the Indians together, and have brought them here to hear what I say; I speak the words of all.

1837 Treaty of St Peters:
ARTICLE 1.

“The said Chippewa nation cede to the United States all that tract of country included
within the following boundaries:

thence to and along the dividing ridge between the waters of Lake Superior and those of the Mississippi
[…]

Father it was not my voice, that sold the country last summer. The land was not mine; it belonged to the Indians beyond the mountains. When our Great Father told us at St Peters that it was only the country beyond the mountains that he wanted I was glad. I have nothing to say about the Treaty, good, or bad, because the country was not mine; but when it comes my time I shall know how to act. If the Americans want my land, I shall know what to say. I did not like to stand in the road of the Indians at St Peters. I listened to our Great Father’s words, & said them in my heart. I have not forgotten them. The Indians acted like children; they tried to cheat each other and got cheated themselves. When it comes my time to sell my land, I do not think I shall give it up as they did.

What I say about the payment I do not say on my own account; for myself I do not care; I have always been poor, & don’t want silver now. But I speak for the poor half breeds.

There are a great many of them; more than would fill your house; some of them are very poor They cannot go to St Peters for their money. Our Great Father told us at St Peters, that you would divide the money, among the half breeds. You must not mind those that are far off, but divide it fairly, and give the poor women and children a good share.

Father the Indians all say they will not go to St Peters for their money. Let them divide it in this parts if they choose, but one must have ones here. You must not think you see all your children here; there are so many of them, that when the money and goods are divided, there will not be more than half a Dollar and a breech cloth for each one. At Red Cedar Lake the English Trader (W. Aitken) told the Indians they would not have more than a breech cloth; this set them to thinking. They immediately held a council & their Indian that had the paper (The Treaty) said he would not keep it, and would send it back.

It will not be my place to come in among the first when the money is paid. If the Indians that own the land call me in I shall come in with pleasure.

1837 Treaty of St Peters:
ARTICLE 4.

“The sum of seventy thousand dollars shall be applied to the payment, by the United States, of certain claims against the Indians; of which amount twenty eight thousand dollars shall, at their request, be paid to William A. Aitkin, twenty five thousand to Lyman M. Warren, and the balance applied to the liquidation of other just demands against them—which they acknowledge to be the case with regard to that presented by Hercules L. Dousman, for the sum of five thousand dollars; and they request that it be paid.

We are afraid of one Trader. When at St Peters I saw that they worked out only for themselves. They have deceived us often. Our Great Father told us he would pay our old debts. I thought they should be struck off, but we have to pay them. When I heard our debts would be paid, it done my heart good. I was glad; but when I got back here my joy was gone. When our money comes here, I hope our Traders will keep away, and let us arrange our own business, with the officers that the President sends here.

Father I speak for my people, not for myself. I am an old man. My fire is almost out – there is but little smoke. When I set in my wigwam & smoke my pipe, I think of what has past and what is to come, and it makes my heart shake. When business comes before us we will try and act like chiefs. If any thing is to be done, it had better be done straight. The Indians are not like white people; they act very often like children. We have always been good friends to the whites, and we want to remain so. We do not [even?] go to war with our enemies, the Sioux; I tell my young men to keep quiet.

Father I heard the words of our Great Father (Gov. Dodge) last summer, and was pleased; I have not forgotten what he said. I have his words up in my heart. I want you to tell him to keep good courage for us, we want him to do all he can for us. What I have said you have written down; I [?] you to hand him a copy; we don’t know your ways. If I [?] said any thing [?] dont send it. If you think of any thing I ought to say send it. I have always listened to the white men.

At the request of some of the petitioners, encloses a petition dated 7 March 1838, addressed to the Prest, signed by 167 Chip. half breeds, praying that the amt stipulated by the late Chip. Treaty to be paid to the half breeds, to satisfy all claims they ma have on the lands ceded by this Treaty, may be distributed at Lapointe.

Hopes their request will be complied with; & thinks their annuity should likewise be paid at Lapointe.

I have the honor herewith to enclose a petition addressed to the President of the United States, handed to me with a request by several of the petitioners that I would forward it. The justice of the demand of these poor people is so obvious to any one acquainted with their circumstances, that I cannot omit this occasion to second it, and to express a sincere hope that it will be complied with. Indeed, if the convenience and wishes of the Indians are consulted, and as the sum they receive for their country is so small, these should, I conciev, be principle considerations, their annuity will likewise as paid here; for it is a point more convenient of access for the different bands, that almost any other in their own country, and one moreover, where they have interests been in the habit of assembling in the summer months.

The humble petition of the undersigned Chippewa Half-Breeds citizens of the United States respectfully shareth

That your petitioners having lately heard, that a Treaty has been concluded between the Government of the United States and the Chippewa Indians at St Peters for the cession of certain lands belonging to that tribe;

For more information about the families and circumstances identified in these petitions from La Pointe, we strongly recommend Theresa M. Schenck’s excellent book All Our Relations: Chippewa Mixed-Bloods and the Treaty of 1837.

That the said Chippewa Indians having a just regard to the interest and wellfare of their Half-Breed brethern, did there and then stipulate, that a certain sum of money should be paid once for all unto the said Half-Breeds, to satisfy all claims, they might have on the lands so ceded to the United States;

That your petitioners are ignorant of the time and place, where such payment is to be made; and

That the great majority of the Half-Breeds entitled to a portion of said sum of money are either residing at Lapointe on Lake Superior, or being for the most part earning their livelihood from the Traders, are consequently congregated during the summer months at the aforesaid place;

Your petitioners therefore humbly solicit their Father the President to take their case into consideration, and not subject them to a long and costly journey on ordering the payment to be made at any convenient distance, but on the contrary, they wish, that in his wisdom he will see the justice of this petition and that he will be pleased to order the same to be distributed at Lapointe agreeably to their request.

Your petitioners entertain the flattering hope, that their petition will not be made in vain and as in duly bound will ever pray.

1827 Deed for Old La Pointe

Chief Buffalo and other principal men for the La Pointe Bands of Lake Superior Chippewa began signing treaties with the United States at the 1825 Treaty of Prairie Du Chien; followed by the 1826 Treaty of Fond Du Lac, which reserved Tribal Trust Lands for Chippewa Mixed Bloods along the St. Mary’s River between Lake Superior and Lake Huron:

ARTICLE 4.

The Indian Trade & Intercourse Act of 1790 was the United States of America’s first law regulating tribal land interests:

SEC. 4. And be it enacted and declared, That no sale of lands made by any Indians, or any nation or tribe of Indians the United States, shall be valid to any person or persons, or to any state, whether having the right of pre-emption to such lands or not, unless the same shall be made and duly executed at some public treaty, held under the authority of the United States.

640 acres is a Square Mile; also known as a Section of land.

It being deemed important that the half-breeds, scattered through this extensive country, should be stimulated to exertion and improvement by the possession of permanent property and fixed residences, the Chippewa tribe, in consideration of the affection they bear to these persons, and of the interest which they feel in their welfare, grant to each of the persons described in the schedule hereunto annexed, being half-breeds and Chippewas by descent, and it being understood that the schedule includes all of this description who are attached to the Government of the United States, six hundred and forty acres of land, to be located, under the direction of the President of the United States, upon the islands and shore of the St. Mary’s river, wherever good land enough for this purpose can be found; and as soon as such locations are made, the jurisdiction and soil thereof are hereby ceded. It is the intention of the parties, that, where circumstances will permit, the grants be surveyed in the ancient French manner, bounding not less than six arpens, nor more than ten, upon the river, and running back for quantity; and that where this cannot be done, such grants be surveyed in any manner the President may direct. The locations for Oshauguscodaywayqua and her descendents shall be adjoining the lower part of the military reservation, and upon the head of Sugar Island. The persons to whom grants are made shall not have the privilege of conveying the same, without the permission of the President.

The aforementioned Schedule annexed to the 1826 Treaty of Fond du Lac included (among other Chippewa Mixed Blood families at La Pointe) the families of Madeline & Michel Cadotte, Sr. and their American son-in-laws, the brothers Truman A. Warren and Lyman M. Warren:

  • To Michael Cadotte, senior, son of Equawaice, one section.

  • To Equaysay way, wife of Michael Cadotte, senior, and to each of her children living within the United States, one section.

  • To each of the children of Charlotte Warren, widow of the late Truman A. Warren, one section.

  • To Ossinahjeeunoqua, wife of Michael Cadotte, Jr. and each of her children, one section.

  • To each of the children of Ugwudaushee, by the late Truman A. Warren, one section.

  • To William Warren, son of Lyman M. Warren, and Mary Cadotte, one section.

Now, if it seems odd for a Treaty in Minnesota (Fond du Lac) to give families in Wisconsin (La Pointe) lots of land in Michigan (Sault Ste Marie), just remember that these places were relatively ‘close’ to each other in the sociopolitical fabric of Michigan Territory back in 1827.  All three places were in Michilimackinac County (seated at Michilimackinac) until 1826, when they were carved off together as part of the newly formed Chippewa County (seated at Sault Ste Marie).  Lake Superior remained Unceded Territory until later decades when land cessions were negotiated in the 1836, 1837, 1842, and 1854 Treaties.

Ultimately, the United States removed the aforementioned Schedule from the 1826 Treaty before ratification in 1827.

Several months later, at Michilimackinac, Madeline & Michel Cadotte, Sr. recorded the following Deed to reserve 2,000 acres surrounding the old French Forts of La Pointe to benefit future generations of their family.

Bizhiki (Buffalo), Gimiwan (Rain), Kaubuzoway, Wyauweenind, and Bikwaakodowaanzige (Ball of Dye) signed the 1826 Treaty of Fond Du Lac as the Chief and principal men of La Pointe.

This 1827 Deed may be the earliest written record of the modern placename Magdalen (aka Madeline) Island. This placename did not become commonly used until the 1850s. Records from the 1830s and 1840s used other placenames such as La Pointe and Middle Island.

Whereas the Chief and principal men of the Chippeway Tribe of indians, residing on and in the parts adjacent to the island called Magdalen in the western part of Lake Superior, heretofore released and confirmed by Deed unto Magdalen Cadotte a Chippeway of the said tribe, and to her brothers and sisters as tenants in common, thereon, all that part of the said Island called Magdalen, lying south and west of a line commencing on the eastern shore of said Island in the outlet of Great Wing river, and running directly thence westerly to the centre of Sandy bay on the western side of said Island;

and whereas the said brothers and sisters of said Magdalen Cadotte being tenants in common of the said premises, thereafterwards, heretofore, released, conveyed and confirmed unto their sister, the said Magdalen Cadotte all their respective rights title, interest and claim in and to said premises,

and whereas the said Magdalen Cadotte is desirous of securing a portion of said premises to her five grand children viz; George Warren, Edward Warren and Nancy Warren children of her daughter Charlotte Warren, by Truman A. Warren late a trader at said island, deceased, and William Warren and Truman A. Warren children of her daughter Mary Warren by Lyman M. Warren now a trader at said Island;

Reverend Sherman Hall came here in 1831 to start a Protestant mission for the American Board of Commissioners for Foreign Missions in response to years of prayer from Lyman M. Warren.

and whereas the said Magdalen Cadotte is desirous to promote the establishment of a mission on said Island, by and under the direction, patronage and government of the American board of commissioners for foreign missions, according to the plan, wages, and principles and purposes of the said Board.

William Whipple Warren was one of the beneficiary grandchildren named in this Deed.

Now therefore, Know all men by these presents that we Michael Cadotte and Magdalen Cadotte, wife of the said Michael, of said Magdalen Island, in Lake Superior, for and in consideration of one dollar to us in hand paid by Lyman M. Warren, the receipt whereof is hereby acknowledged, and for and in consideration of the natural love and affection we bear to our Grandchildren, the said George, Edward, Nancy, William W., and Truman A. Warren, children of our said daughters Charlotte and Mary;

and the further consideration of our great desire to promote the establishment of a mission as aforesaid, under and by the direction, government and patronage of Board aforesaid, have granted, bargained, sold, released, conveyed and confirmed, and by these presents do grant, bargain, sell, release, convey and confirm unto the said Lyman M. Warren his heirs and assigns, out of the aforerecited premises and as part and parcel thereof a certain tract of land on Magdalen Island in Lake Superior, bounded as follows,

Michel Cadotte, Sr. and his sons-in-laws, the brothers Truman A. Warren and Lyman M. Warren, settled at or near Old Fort, aka Northern Yellow-Shafted Flicker Point (Mooningwane-neyaashi); now known as Grant’s Point.  The first French fort of 1600s was here.
Great Wing River appears to be a presently Unnamed Creek on Chebomnicon Bay (Zhaaboominikaaning).
Sandy Bay (Wiikwedaawangaag) is now known as La Pointe’s Middleport.  The second French fort of 1700s was here.
The Portage appears to a connection between the headwaters of Middleport’s creek and Chebomnicon Bay’s creek.
New Fort” began about 1834 when Lyman M. Warren moved the American Fur Company post from Old Fort to here.

that is to say, beginning at the most southeasterly corner of the house built and now occupied by said Lyman M. Warren, on the south shore of said Island between this tract and the land of the grantor, thence on the east by a line drawn northerly until it shall intersect at right angles a line drawn westerly from the mouth of Great Wing River to the Centre of Sandy Bay, thence on the north by the last mentioned line westward to a Point in said line, from which a line drawn southward and at right angles therewith would fall on the site of the old fort, so called on the southerly side of said Island; thence on the west by a line drawn from said point and parallel to the eastern boundary of said tract, to the Site of the old fort, so called, thence by the course of the Shore of old Fort Bay to the portage; thence by a line drawn eastwardly to the place of beginning, containing by estimation two thousand acres, be the same more or less, with the appurtenances, hereditaments, and privileges thereto belonging.

To have and to hold the said granted premises to him the said Lyman M. Warren his heirs and assigns: In Trust, Nevertheless, and upon this express condition, that whensoever the said American Board of Commissioners for foreign missions shall establish a mission on said premises, upon the plan, usages, principles and purposes as aforesaid, the said Lyman M. Warren shall forthwith convey unto the american board of commissioners for foreign missions, not less than one quarter nor more than one half of said tract herein conveyed to him, and to be divided by a line drawn from a point in the southern shore of said Island, northerly and parallel with the east line of said tract, and until it intersects the north line thereof.

Roughly 2,100 acres lies south of Middle Road.

And as to the residue of the said Estate, the said Lyman M. Warren shall divided the same equally with and amongst the said five children, as tenants in common, and not as joint tenants; and the grantors hereby authorize the said Lyman M. Warren with full powers to fulfil said trust herein created, hereby ratifying and confirming the deed and deeds of said premises he may make for the purpose ~~~

In witness whereof we have hereunto set our respective hands, this twenty fifth day of july A.D. one thousand eight hundred and twenty seven, of Independence the fifty first.

This is one of several posts on Chequamegon History featuring the original U.S. General Land Office surveys of the La Pointe (Bad River) Indian Reservation.  An earlier post, An Old Indian Settler, features a contentious memoir from Joseph Stoddard contemplating his experiences as a young man working on the U.S. General Land Office’s crew surveying the original boundaries of the Reservation.  In his memoir from 1937, Stoddard asserted the following testimony:

“As a Christian, I dislike to say that the field representatives of the United States were grafters and crooks, but the stories related about unfulfilled treaties, stipulations entirely ignored, and many other things that the Indians have just cause to complain about, seem to bear out my impressions in this respect.”

In the winter of 1854 a general survey was made of the Bad River Indian Reservation.

[…]

It did not take very long to run the original boundary line of the reservation.  There was a crew of surveyors working on the west side, within the limits of the present city of Ashland, and we were on the east side.  The point of beginning was at a creek called by the Indians Ke-che-se-be-we-she (large creek), which is located east of Grave Yard Creek.  The figure of a human being was carved on a large cedar tree, which was allowed to stand as one of the corner posts of the original boundary lines of the Bad River Reservation.

After the boundary line was established, the head surveyor hastened to Washington, stating that they needed the minutes describing the boundary for insertion in the treaty of 1854.

We kept on working.  We next took up the township lines, then the section lines, and lastly the quarter lines.  It took several years to complete the survey.  As I grew older in age and experience, I learned to read a little, and when I ready the printed treaty, I learned to my surprise and chagrin that the description given in that treaty was different from the minutes submitted as the original survey.  The Indians today contend that the treaty description of the boundary is not in accord with the description of the boundary lines established by our crew, and this has always been a bone of contention between the Bad River Band and the government of the United States.

The mouth of Ke-che-se-be-we-she Creek a.k.a. the townsite location of Ironton is featured in our Barber Papers and Penokee Survey Incidents.  Today this location is known as the mouth of Oronto Creek at Saxon Harbor in Iron County, Wisconsin.  The townsite of Ironton was formed at Ke-che-se-be-we-she Creek by a group of land speculators in the years immediately following the 1854 Treaty of La Pointe.  Some of these speculators include the Barber Brothers, who were U.S. Deputy Surveyors surveying the Reservation on behalf of the U.S. General Land Office.  It appears that this was a conflict of interest and violation of federal trust responsibility to the La Pointe Band of Lake Superior Chippewa.

This post attempts to correlate historical evidence to Stoddard’s memoir about the mouth of Ke-che-se-be-we-she Creek being a boundary corner of the Bad River Indian Reservation.  The following is a reproduction of a petition draft from Reverend Leondard Wheeler’s papers, who often kept copies of important documents that he was involved with.  Wheeler is a reliable source of evidence as he established a mission at Odanah in the 1840s and was intimately familiar with the Treaty and how the Reservation was to be surveyed accordingly. 

Wheeler drafted this petition six years after the Treaty occurred; this petition was drafted more than seventy-five years earlier than when Stoddard’s memoir of the same important matter was recorded.  The length of time between Wheeler’s petition draft and Stoddard’s memoir demonstrates how long this was (and continued to be) a matter of great contemplation and consternation for the Tribe.  Without further ado, we present Wheeler’s draft petition below:

The undersigned persons connected with the Odanah Mission, upon the Bad River Reservation, and also a portion of those Chiefs who were present and signed the Treaty of Sept 30th, AD 1854, would most respectfully call your attention to a few Statements affecting the interests of the Indians within the limits of the Lake Superior Agency, with a view to soliciting from you such action as will speedily see one to the several Indian Bands named, all of the benefits guaranteed to them by treaty stipulation.

“Beginning on the South shore of Lake Superior a few miles west of Montreal River at the mouth of a creek called by the Indians Ke-she-se-be-we-she, running thence South &c.”

Your petioners would represent that at the time of the wording of this particular portion of the Treaty, the commissioner on the part of the United States inquired the number of miles between the mouth of the Montreal River and the mouth of the creek referred to, in reply to which, the Indians said “they had no knowledge of distance by miles” and therefore the commissioner assumed the language of “a few miles west of Montreal River” as discriptive of the creek in mind.  This however, upon actual examination of the ground, does to the Band the greatest injustice, as the mouth of the creek to which the Indians referred at the time is even less than one mile west of the mouth of the Montreal.*

*This creek at the time was refered to as having Deep water inside the Bar” sufficient for Boats which is definitive of the creek still claimed as the starting point, and is not descriptive of the most westerly creek.

The mouth of Ke-che-se-be-we-she Creek was renamed as Ironton by a group of land speculators in the years immediately following the 1854 Treaty of La Pointe.  Some of these speculators include the Barber Brothers, who were U.S. Deputy Surveyors surveying the Reservation.  Ironton is featured in our Barber Papers and Penokee Survey Incidents.

But White men, whose interests are adverse to those of the Indians now demand that the Reservation boundary commence at an insignificant and at times scarcely visible creek some considerable distance west of the one referred to in the Treaty, which would lessen the aggregate of the Reservation from 3 to 4000 acres.

The Barber Brothers worked on the 1854 survey, 1856 survey, and 1858 survey of the La Pointe (Bad River) Reservation, but these surveys are apparently not available online through the United States General Land Office or the Wisconsin State Cartographers Office websites.

Your petioners, have for years, desired and solicited a settlement of the matter, both for the good of the Indians and of the Whites, but from lack of interest the administrations in power have paid no attention to our appeals, as is also true of other matters to which we now call your attention.

As many heads of families now wish to select (within the portion of Town 47 North of Range 1 West belonging to the Reservation the 80 acre tract assigned to them) we desire that the Eastern Boundary of the Reservation be immediately established so that the subdivisions may be made and and land selected.

Your petioners would further [represent?] that under the 3d Section of the 2nd article of the Treaty referred to the Lac De Flabeau, and Lac Court Orelles Bands are entitled to Reservations each equal to 3 Townships, (See article 3d of Treaty.  These Reservations have never been run out, none have any subdivisions been made.) which also were to be subdivided into 80 acre Tracts.

Article 4th promises to furnish each of the Reservations with a Blacksmith and assistant with the usual amount of Stock, where as the Lac De Flambeau Band have never yet had a Blacksmith, though they have repeatedly asked for one.

As the matters have referred to one of vital importance to these several Bands of Indians, we earnestly hope that you will give your influence towards securing to them, all of the benefits named in the Treaty and as the subject named will demand labor entirely outside of the ordinary duties of an Indian Agent, and as it will be important for some one to visit the Reservations Inland, so as to be able to report intelligently upon the actual State of Things, we respectfully suggest that Mr Asaph Whittlesey be specially commissioned (provided you approve of the plan and you regard him as a suitable person to act) to attend to the taking of the necessary depositions and to present these claims, with the necessary maps and Statistics, before the Commissioner of Indian Affairs at Washington, the expense of which must of necessity, be met by the Indian Department.

Asaph Whittlesey was appointed to serve as the Indian Agent at the La Pointe Indian Agency from 1861 until 1869.  We have not yet found any evidence that Whittlesey addressed any discrepancies about Bad River’s northeast boundary corner not being the true location of Ke-che-se-be-we-she Creek in accordance with the Treaty.

Mr Whittlesey was present at the making of the Treaty to which we refer, and is well acquainted with the wants of the Indians and with what they of right can claim, and in him we have full confidence.

In addition to the points herein named should you favor this commission, we would ask him to attend to other matters affecting the Indians, upon which we will be glad to confer with you at a proper time.

The undersigned L H Wheeler and Henry Blatchford have no hesitency in saying that the representations here made are full in accordance with their understanding of the Treaty, at the time it was drawn up, they being then present and the latter being one of the Interpreters at the time employed by the General Government.
